Hi!

The AOS package requires to send recent Tax returns, but my husband has been deployed whole year of 2011 (being deployed no tax is been withdrawn), therefore he didn't get any tax returns. Can I just file his W2 or there is any other way?

18th March 2010- Application is accepted

23rd March 2010- Touched....

30th September 2010- Approved at USCIS Vermont

5th October 2010- Case was received at NVC

7th October 2010- Hard Copy NOA2

28th October 2010- Embassy received our case (US Embassy in Bangkok)

5th November 2010- Got Packet 3 from the Embassy

As an active duty member of the armed services serving time in a combat zone, your husband gets an automatic 180 days from the last day in a combat zone to file his tax returns. The tax deadline is also extended by the number of days between deployment and April 15. The extension to file applies to spouses of military members deployed to combat zones as well.

Make a cover letter explaining that your husband was deployed for the duration of 2011 and attach a copy of IRS Publication 3 Armed Forces' Tax Guide highlighting "Extension of Deadlines" page 24. Also attach or include the W-2s you have, it is your only proof of income.
