hi everyone..pls i need ur help..came to US in 2010 to meet my US citizen bf then sept.2011 came back to visit him again..he got sick and hospitalized in nov. so we decided to get married in dec..im supposed to leave last jan.16 this year but my I-94 is until march 21 yet so i decided to rebook my travel date to march 15 to have more time for each other..we cry each day as my departure date is getting closer... we dont want to be away from each other anymore..i worry he will have panic attacks again which i know its been months since im here that he didnt have by it..i know its really depressing for both of us..whats best i could do? tnx for sharing ur views

You both may file I-130 ( CR-1 ), and after that, may request for expedite your case on medical grounds. If expedite request is approved, then all this process should be taken care in couple of months.

Please note, while your I-130 application is under process, you may have rare chance to get entry in US, since you would be considered as intended immigrant.

Moved from Tourist Visas to IR-1/CR-1 Process & Procedures; this is the path the OP will need to take.

Incorrect and incomplete information. Only the US Citizen files an I-130, not the foreign citizen spouse. You also did not mention to the OP that expedite requests have to be made at each stage as a granted expedite request does not carry over from stage to the next.

The I-130 is a petition and it's the USC's petition, it's not an application.
