Hi,

Recently I filed I-130 for my wife under her maiden name. Few days later my wife told me that she went and changed her last name to my name.

So i asked her to go back to the office and ask them to change the name back to what it was as I've already filed the petition under her maiden name.

She was told that she cannot change her name back to what it was before.

So my cocern now is that since I filed the petition under her maiden name, how can I prove to USCIS that the person I'm sponsoring is actually the same person? My wife's passport that she just received has my name on it not her maiden name. but on the I-130 I filed has her maiden not mine.

Can anyone please help with what I have to do to fix this error.

I'd really appreciate the help.

You tell them she changed her name - provide the marriage certificate and the ID proving the name change. Thats it.

Can I send the proof after I-130 is approved? when approved they'll ask me for proof of marriage so when i provide that, should I send them the copy of Marriage Certificate and ID along with the other stuff? should I include a note explaining what happened?

when you sent in your i-130 you also sent copy of marriage certificate, that is all the proof they need, you dont have to send anything, they know in order for her to travel she must change her name n passport I.D etc. its nothing to worry over! I did the same, and i am on my NVC stage.. everything goinf smoothe
