L1 visa holder wanting to change jobs with pregnant wife

Dear all,

Thank you for taking the time to read this thread.

I currently work for a multinational that has transferred me to the USA on an L1 visa. My wife is on an L2 visa.

A different company, with their headquarters outside of the USA has asked me to join their company, to work in the USA.

I understand that the L1 visa is non-transferable, and that the H1 quota is already filled. So, the earliest time I would be able to begin working for them in the USA is October 1st 2012 (assuming I am granted a H1 visa).

My concern is that my wife has become recently pregnant and I was hoping to avoid leaving the USA (there are health insurance implications as pregnancy is a pre-existing condition, so I would have to enact the COBRA option) and was hoping that there might be another option out there.

Furthermore, if anyone knows if the COBRA healthcare option still works even if you have left the USA (let's assume I leave the USA on 1st May and return 1st October, but I keep paying the premiums) then that would be greatly helpful.

Does anyone have any ideas?

Why not just carry on working for your current employer until 1st Oct?
