I-864 does this apply to both of us?

I just found out I may be pregnant, but I am leaving to go back to the united states in June and my husband will be staying here to wait out the VISA process... Only issue is if I am pregnant I may have to go on state medicad because I don't have medical insurance back in the states because I have been out of the country for 7 months and do not have a job back home. Now I guess I am asking since we are married and I have to go on medicad to have the baby does that jeapordize the I-864 since it talks about not going on assistance? I have a friend who is sponsoring my husband into the country and makes more than enough money to cover us. Then the next question if I am pregnant do I need to list the unborn baby on the I-864? sorry to be so confusing..

Sept 1, 2011: Met at a service station my first night in England

Sept 15, 2011: Came down to where I go to University to spend a week with me

Oct 15, 2011: Went to London to be with him.. one of many trips between us

Oct 30, 2011: Engaged

Dec 20, 2011: Married

Feb 20, 2011: I-130 Sent

Mar 12, 2011: Rejected because of payment, waiting for packet to come back so I can resubmit it with proper payment.

April: Another rejection because I signed in the wrong place

May 1 2012: Sent I-130 AGAIN

May 7 2012: Received NOA1

May 17 2012: Received NOA2

June 18 2012: NVC stuff came in

July 6 2012: Called because never received NVC info

July 10 2012: Email with instructions received

August 1 2012: sent out AOS payment and AOS packet plus the other form

August 29 2012: had to get on a plane and fly away from the love my life.

Sept 12 2012: still no news from NVC, refiling all of my paperwork... feels like we have been apart forever already

Sept 14 2012: Emailed 3032 and resent I-864 with case number on every page, cover sheet and rechecked about 35 times to make sure it was all right

Oct, 1 2012: didn't check well enough received RFE

Oct, 13 2012: resent the packet with the information needed by the NVC

Oct, 14: Husband sent DS 230 from the UK

No a USC can get any help they need from any source. It is only when the immigrant gets means tested benefits that the sponsor has to repay every cent.

Thank you for the quick reply, I was just worried because I know in some states they consider things to be combined... like cars etc I wasn't sure if medical bills were included

Only your immigrant husband needs to worry about receiving means tested benefits. You and your child can receive anything that US citizen are entitled to. Just be careful that your husband is not granted these benefits if you and your child apply for them.

The baby is only added to your hosehold count when he/she is born. The baby will not change the household count for the Joint Sponsor.

Thank you Aaron, I just found out as well that our Joint sponsor will be retiring this year cutting his income in half which is still enough for 3 people but with a 4th do I need to look into finding a bit more income, or since I should be working by that time will the combined income work together?

You and the baby won't be in the sponsor's people count.

Sponsor is single-- He + immigrant = 2

Sponsor is married--He, his wife + immigrant = 3

Is that what you were asking?

The baby does not change the Joint Sponsor's household count. The JS does not include you or the baby in his/her household count.
