hi all,

I am currently on a student visa studying in the United States. I recently proposed to my girlfriend who is an American. We have plans to get married this summer and I am confused with the K-1 Visa stuff. I am hoping that others have already been down the path that I am taking...

A couple of questions:

1) If I am already legally in the United States, but we plan to stay once I am finished with my school, does my partner need to apply for a K-1 Visa for me still?

2) If so, when should this be done?

3) And if not, what do I need to do to legally remain in the US once I am done with my school?

4) Since will remain on a student visa for another year, is this a process that could wait until after we are married, or should we begin the process now?

In your case, since you are in the US on a valid visa, once you get married, you'd file a concurrent I-130/I-485 application for adjustment of status. No K-1 visa.

In your case, since you are in the US on a valid visa, once you get married, you'd file a concurrent I-130/I-485 application for adjustment of status. No K-1 visa.

Thanks for the quick reply! Would that make me eligible to find a job once I finish my school? Or is there something else that I would need to apply for in conjunction with the 1-130/I-485?
