Best step to stall at NVC stage?

Hi all,

I am a Swedish beneficiary of my USC Wife, we both live in Sweden since 7 yrs back, have been married for 6 and have 2 USC sons (CRBA).

She filed my I-130 and got NOA1 January 23rd and we then received NOA2 with approval on Feb 2nd (9 days).

The problem is we had expected a 5 month process for the I-130 approval and are not able to immigrate until December this year.

As I understand it is possible to delay the next steps by not sending in information for a month or two at various steps in the NVC process.

I am wondering where the best step to delay is? I would like to delay after whatever step takes the longest if possible. Ideally I would like to end up with a visa around September or so to give us some leeway in moving. I am not clear on how many response steps there are in the process

.

As a second question, does anyone think we will have Domicile issues?, My wife has maintained a mailing address in the US at her parents, she has voted, kept her drivers license and we are currently filing her past taxes (we didn't know she had to do that but she will get the Foreign earned income exclusion) We are in the process of opening a bank account and transferring a majority of our savings over as well. Also her Dad will be a joint sponsor since we both have to quit our jobs when moving over.

Any suggestions from experience are much appreciated.

I guess you could delay it like that, but i wouldn't wait too long sending the papers to NVC. But wait like a month and then you can wait like a month to get your stuff ready for the embassy. And you know you have 6 months to enter on your visa when it's been issued.

Well, if I were you, I would put things on hold before paying any fees, but after establishing contact with the NVC. So, that would be after sending the DS3032 Choice of Agent form. They will send you an invoice for the affidavit of support fee, and then you can wait for pretty much as long as you want to pay it.

NVC keeps your file open for one year after last contact, and just giving them a call resets the clock, so you can really take your time.

When you're ready, the NVC stage can be really fast these days. Look at the NVC filers January and February threads, you'll see the timelines. In the very first post of both threads, you'll also find useful links describing each step at NVC.

Things you'll have to take into account to decide when to resume the application: if you are proactive, the whole NVC stage can take less than 3 weeks; it takes a while from your case being complete at NVC to being given an interview date at the embassy, but this is country specific, so check recent timelines of other applicants from Sweden to see how long it usually takes; the interview date can be set for several months later, again, look at the portal for Sweden; the visa once issued is usually valid for 6 months (unless the passport or medical exam expires earlier).

I don't know much about domicile issues but I'm sure someone can help you!

02/01/24: N-400 submitted online; Biometrics reuse notice received immediately online; "case being actively reviewed" after a couple hours

02/09/24: received NOA1 by mail

02/10/24: received biometrics reuse notice by mail

04/08/24: interview scheduled for 05/14. Received "We have taken an action in your case" email.

05/14/24: approved at interview, same-day oath ceremony in San Francisco 🥳 🇺🇸

Why not? The I130 approval doesn't expire. Even if they don't receive any news from you within a year, they just ask you to repay all fees and send back anything you had already sent to reopen the case.

By the way, since you went through USCIS and NVC, this is not a DCF case, but a regular IR1 case.

Getting your approval from USCIS superfast is due to the new handling of ex-DCF cases. Happened to all of us in the same situation since October.

I really appreciate the help. It makes sense to stall it after first contact as Laurie&Colin suggest,

Things seem to be really easy and straight forward when filing in Sweden (Knock on wood)

I feel like a jerk for having the opposite problem of pretty much everyone else on these forums.

It's not our fault if we are lucky :)

After my approval in 2 weeks time, the panic hunt for my police certificate from abroad began, I didn't know I would have so little time to secure it :lol:

It's a good surprise but still, you don't have all the time you thought you would to get ready!
