Ok so my fiances interview is about a month away and getting afraid that there going to denied it. in your opinion what do u think might happen

ok so my fiance had a tourist visa in 2009 and he was on vacation and stayed in tucson arizona for 2 months. The only problem was that he didnt ask permission to stay longer. and if ur going to stay in tucson more then 3 days u need to ask permission. so border potral stopped him the day before he was going to leave back to mexico and saw that he had been her for 2 months and they took his toursit visa away and gave him a puishment of 1 year and a half. Which he completed last year.

Well, he didn't enter illegally -- he entered with a visa and overstayed. That's in your favor -- if he had entered illegally that would have definitely been cause for a denial.

The way I see it —and granted, I'm not a consular officer, but for what it's worth — he did the crime, and did the time. I don't see any reason why they'd deny him.

Stay positive, have a contingency plan, and don't waste time worrying about things you can't control. :)

If he was barred from entering the US for a year and a half, and the time is well past now, then there should be no problem. If he is asked about being in the US before, previous tourist visas, and if he ever overstayed, then he should just answer truthfully and explain his situation and that his bar is over.

If his bar was still in place, then there would be a problem. He is eligible again to enter the US now, so this would not be a reason to deny the K-1.
