help! i have a dilemma. my NOA for my EAD was last Nov. 17, 2005. I received a notice for my biometrics to be done on Feb. 27, 2006. However, Feb 27 is already outside the 90 day processing time. Can I apply for an interim EAD?

The only thing I could suggest is getting an infopass after the 90th day otherwise just go to the biometrics appointment and wait for the EAD afterwards. It took Claudeth about a month to receive hers after the biometrics.

You certainly can. But the outcome would depend on how your local office treats such cases. Mine refused to do anything, but many others would issues the card or give you same day biometrics. If it's convenient for you to go, you should give it a try.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

I went ahead and scheduled thru infopass in my local office (memphis, tn). When I came there, there was no line at all, I was called about 5 minutes after I arrived and found out that my EAD was approved last Jan. 17, 2006. She cannot give me an interim EAD because of this. She said they just need my biometrics. When she found out that my biometrics schedule is this Monday, she went ahead and squeezed me in the same day so I won't have to come back. After about 10 minutes, they took my biometrics and said to wait for my EAD in about 2-3 weeks. I must say that they are very efficient and quick in that office. I hope to get my EAD as promised!

you don't have to be afraid. just try it, who knows? and also, you don't need to call themto schedule an infopass. just log on to www.usics.gov. then go to infopass and schedule an appointment. you have to option there what reasons you have for going. choose "it's been more than 90 days since i applied for EAD".

Glad that it works out. If your EAD was already approved by MSC, it should arrive very soon after biometrics. I was in the same situation (approved, no biomtrics), and my card arrived within 7 days.
