Q 25 I -864

Hi,

I am submitting form I864, however I had no income in past 3 years and my parents claimed me as dependent. My husband who is the intending immigrant is employed and I am using his income to meet the Income requirement. What do put in question 25, do we need to submit his tax return along with the I 864 application?

Will his current income continue after his arrival in the US? If the answer is no, then his income does not qualify and you cannot use it. You will require a joint sponsor in this scenario.

If I were claimed as a dependent by my parents in their tax return in 08 & 09 and filed jointly in 2010 with my husband, all these years I was a student and had no income. What do I put in q- 25 of form i 864, should I check, "I have filed a fedral tax return of the 3 most recent tax years. I have attached a photocopy or transcript of my fedral tax return for only most recent year"

2nd Question- Should I attach our joint return (latest year 2010) if I check the above option ?

You were quite clear in your earlier post, I knew you were the petitioner. My original question still stands; you stated you were using your husband's income to meet sponsorship requirements. The only way that will be possible is if that source income will continue uninterrupted upon his arrival in the US. If that source will not continue upon his arrival, then it does not qualify and you therefore cannot use it to meet sponsorship requirements. If you cannot meet the sponsorship requirements on your own, you will require a joint sponsor.
