I am still awaiting my NOA2 and it looks like it might be a wait. I want the NVC process to go very quickly and smoothly as possible. I would want to go with electronic processing. I have read many of the info including Saylin's wiki for Montreal but I wanted to make sure I understand everything correctly. Please let me know if I have incorrect assumptions.

Preparing AOS Package:

I have filled out I-864 form and I have gathered the following supporting documents:

Letter from Employer

IRS Tax transcripts for the last 5 years

Pay stubs

Bank Statements

1099 for 2011 if I receive it in time. (I was working as a contractor for most of the year)

Do I need to attach the following also?

1040 forms for the tax retruns in addition to the IRS transcript?

W2s for previous years?

Preparing DS260 Package:

The form is filled out online, correct? Once filled out do I print it and does it need to be signed by my spouse and then scanned again for the package? Or do I just need the cover sheet printed? What documents do I need to be signed by my spouse?

In addition to that, I have the following documents of my spouse which I have scanned:

Passport bio page

Birth certificate and translation

Police certificate

Marriage certificate

What else do I need in this package? Do I need to provide proof of a bonafide relationship here or only during the interview?

Do I need to scan the photos and send them with the packagae or is that only needed during the interview?

DS-3032 Choice of agent form:

Is this filled out online? Do I need to have this signed by the beneficiary and then scanned and emailed?

And I really need to write the MTL number on every single page?

Thanks for all your help with this.

We are going to be doing MTL too, and are just slightly ahead of you in processing right now...

Yesterday we opted in for the electronic processing (EP) and got a confirmation email today that our 3 apps have been accepted for EP.

Yesterday my wife (petitioner) also paid the $88 aos fee and it shows on our online banking as pending, so we are just waiting to have it clear on the NVC website and then we are going to proceed with the I-864 stuff.

The hardest part of this whole thing for us is the fact that neither of us presently live or have worked in the US even though my petitioner is the USC...It looks like the AoS stuff is going to be the biggest obstacle for us to overcome.

Thanks for all your help with this.

For the AOS package:

You only need the last three years, not five. Technically, only the last year is required, three is optional. And if you're sending the IRS tax transcripts, then you don't need to send in the 1040s or W2s. NVC much prefers tax transcripts, and if you have them, just send that!

For the DS-260:

Yes, it's filled out online. You submit the form online, so you don't need to print it out, sign it, and send it. NVC will receive it online after you finish and click the submit button. I would suggest printing out the review pages though once you're done. Keep those for your records.

For the IV package:

You just need to include: cover sheet from the payment portal, two passport pictures, birth certificate, marriage certificate, police certificate, and copy of the bio-data page of the passport. There is nothing for the beneficiary to sign (as a Canadian as there is no DS-230 needed).

And nope, no proof of relationship is needed at NVC. Just bring it to the interview. You'll also need an additional two passport pictures for the interview.

For the DS-3032:

There is an online version for Canadians. It's called the DS-261. You'll find it on the same page as the DS-260. Again, since it's an online form, you don't print it out or sign it or anything. Just fill out the form online and hit the submit button. NVC will receive it that way.

For the case number being written on each page, it's not a big deal since you'll be emailing the package. Despite this, I still digitally added the case number to every single page. If you want an easy way, you can do this: get a small post-it note and write the case number on it. And then as you scan each page, just put it on the top right corner.

One more question. For the IV package, how do I attach the two passport pictures? Do I scan these in? I email this package correct? Or do I have to send it by mail?

If you opt in for electronic processing, then you email both the AOS and IV packages in separate emails. If you do EP, then, yes, you scan the passport pictures, like the other documents. I explain in my wiki in further detail how I did this with the two pictures.

I have no idea what I would have done without you and your wonderful wiki article! Thank you!

Hopefully I will get the NOA2 soon.

Saylin, Thank you for the excellent wiki. It made things a little more clear because even today I was confused as to what we should do..

We got our EP approval email, and A0S shows paid, and our D-261 are all done. I was wondering why we couldn't unlock and pay the IV bill, but obviously we have to send in the I-864 before we can go any further.

That is proving to be difficult, as even though my wife is the USC, all our employment and income has been from here in Canada, so we have no US tax documents (not yet anyway). We are filing them now, which is not a big deal as we don't owe any back taxes, but I guess she still needed to file anyway. This seems weird and more difficult trying to do the 864 since we have no US anything right now. It would be different if she had a job in the US or had lived there at some point in the last 30 years

Hopefully we can get this all done and filed and they can send it to MTL...Looking forward to taking the train and spending a few days in a place we have never been.

Thanks for everything!!

The IV bill will become available once the DS-261 has been approved. It should be within a few days. Keep calling the AVR and it should change soon saying something about the Choice of Agent form. And as always, keep an eye out on the payment portal!

Since your wife has been in Canada for what seems like awhile, you might have a tougher time at the interview. They might ask for proof of US domicile of your wife and if she doesn't produce it, you might get put into AP. When is she planning on moving back and getting a job in the US?

I have been trying to use the payment portal to pay the IV and when I click on pay it sends me to the next screen to put a check mark in the box and pay it but it wont let me put a check mark down....I guess the 261 is still pending? I will keep an eye on it, I have never had to call for anything in this whole process yet...hopefully I can keep it that way...lol

I know what you mean about domicile, I have basically been married to a Canadian American for the last 19yrs...lol...She was born in the US and moved back here with here Cdn parents back in 72 when she was 2 yrs old and has been here ever since. House is going up for sale in Spring and we are basically packing it in here to head to the USA.. So yes the I864 and domicile stuff is going to be tricky.

Just to make sure, you're using IE to pay the bills right? I've seen many cases where the payment portal would act weird in Firefox, Safari, Chrome, etc. If you are using IE, then just keep checking the site and it should work sometime soon. If it's still not working by Monday, then I'd suggest calling up NVC and asking.

And yes, definitely be very thorough with everything about the I-864 and proving domicile at the interview. I've heard it's better if the USC moves back to the US before the beneficiary so they can set up a house/apartment as well as getting a job before the interview. It's easier to prove domicile that way. But that might not be a possibility for you two. Just have everything in order, and you should be okay. I'd suggest looking through the DCF threads for Canada. Although you didn't do DCF, your wife has been living in Canada for quite awhile, so you have the same problems to face.
