okay so here's our story, short and sweet.

met my fiance online a year ago today. 1million skype calls, texts, etc. met for the first time in june for the entire month, where he proposed to me at his aunts wedding. i went and visited him in october for 2 weeks, and he just went home today after visiting me for 3 weeks for christmas. we have another visit planned for march 7th for another 2 weeks. He is 21 years old, and I am 19.

we are so madly in love it's unbelievable.

we applied for the fiance visa back in august or september, but it was sent back because we had the amount of the cheque wrong. we fixed it, and re-mailed the application with the proper cheque back to them at the beginning of december.

when we recieved the application back because the cheque was wrong, a whole bunch of the pages were signed.

while my fiance' was here, he checked his online banking and it said the cheque was cashed. yay!

my questions are:

-Are they going to send us another letter saying they received the application and the cheque was cashed? That would be the NOA-1, correct?

- It says processing times for the NOA-2 is 5 months. When they say that, does it mean it WILL take 5 months to receive the NOA-2? or is it a general "within 5 months" thing? What's the fastest this could be done?

another just general thing we were wondering about is if it's not crazy, like they're not dealing with TONS of K-1 visa applications, what's the fastest the process can be from start (re-mailing in december) to when i am approved to move down?

ps; could our age play a big role in their decision? could our entire application be rejected because we're young?

Yes, they should send you a letter 'NOA1' to state that they have received the petition and that will also have a number on it so that you can track your case on line. It could take less than five months but it could also take longer than five months to get your NOA2 it depends a lot on which service centre the petition goes too. When we filed ours it went to CSC and they were working really quick at the time and we got approval in three months. However, i think they are taking quite a lot longer at the moment.

you're 19 and he's 21 yeah? that shouldn't be a problem at all, there are people with much larger age gaps than that. btw, which country are you from?

i'm currently in canada and he's in arizona.

also, another thing that makes me nervous is the income thing.

he's in school full time (graduating in the summer for microbiology) but he has never worked.

looking online it says he has to make $30,000 a year, but again, he doesn't work.

his father passed away years ago and left him a little over $10,000 (which he still has), his mother pays a lot of his bills, and he has a trust fund for over $100,000 he has access to.

could him not having a job pose a problem? D;

Regarding income, he should be able to show income or assets of at least 125% the 2012 poverty level for two people that is about 18, 382.5 (the poverty level for two people is $14,710 according to the Federal Poverty Guidelines. If he doesn't make enough money he should get a co-sponsor. If you say his mom takes care of his bills maybe she could co-sponsor you guys.

Yes, you will get an NOA1 with your case number, so you can check the case status online.

When they say the processing time is 5 months, I have seen the fastest processing time is 3-4 months but don't count on that. Count on 6-7 months from when you file till you have the visa in your passport instead if everything goes well.

Some cases takes even 9-12 months if you get RFE and administrative processing etc.

Young age is not a problem, although they might tell you that you are young and should be studying instead of doing immigration at the interview etc, they cannot deny your visa for that.

However, they can deny your visa for financial reason. You must get a co-sponsor who meet the poverty guild line.

oh AZ? Travis and i live in Arizona too :D Whereabouts in AZ is he?

I don't have an answer for your financial question sorry. the poverty line for two people is actually just under $20,000. With the amount of money he has saved that could very well be enough to satisfy immigration but i would try and find a co sponsor to be on the safe side. You will have to check form instructions but people can qualify as over the poverty line if they have enough in savings.
