Hi VJers, we're putting together our I-130 package these days and had a question about the benficiary's G-325A.

It asks for beneficiary's employer the last 5 years. The beneficiary worked in the US for 8 months while on OPT, quit his job on time and left the US about 40 days into his 60 day grace period.

Q: Is it generally a good idea to add a copy of the beneficiary's old EAD card as proof that it was legal work when filing to the initial petition, or will this not be an issue (if any) until the interview?

You could - but you don't really need to.

Since you provide all the info they need to check the records (SSN/Alien number/Etc..)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

They will already have info of his previous OPT. HOwever, if he still has the card, he may want to turn it in to a US customs officer or at least ask one what he should do with it. I only say this because if he visits you and has it on him for whatever reason, they may accuse him of trying to work while in the US and deny him at the border. (ask me how I know....siiigh...) Once I went through on K-1, they asked me why I still had the EAD card, and once officer told me I should have "turned it in" (like I knew...they always act like its YOUR job to know all the rules) the other let me keep it, and I ended up attaching it to my AOS packet just because they do ask if you've applied for work auth there before, so I just thought I would include it. No idea what they did with it...
