K1 Visa Annotation

Finally my fiancee has been issued a K! Visa, valid from Feb 9 , 2006 to Aug 7, 2006. She wants to settle her affair and has plan to come to the states at the beginning of April. But there is a notation on her visa stating "Petition valid till March 21, 2006 and my name as the petitioner".

Is this something to worry about? Does it means that she has to arrive in the States before March 21 even though her visa is valid till Aug 7? Has anybody seen this type of an annotation on any K1 Visa?

Your petition was the I-129F, the Visa date is what she goes by.

2005

Sept 10 I-129F sent to TSC

2006

Interview - February 13th APPROVED! day 152

April 6 - wedding date day 204

Aug 22 - AOS interview date day 101-total days 342

Sept 29 - green card arrives, done until June 2008 day 140-total days 381

2008

June 30 - I-751 mailed total days 1025

2009

March 9 - Removal of Conditions approved! total days 1277

agreed with both above...

your I-129F petition is valid for 4 months after it's approved, that's the date the actual I-129F expires. But the Visa is good for 6 months after issuance.

Just like the Visa can expire after you get to the USA but before the 90 day marriage. You'll still be allowed to adjust status even with an expired visa, as long as you married within 90 days.

Why they track that on the actaul visa, I have no idea, but they did it with the my first K1 as well. Your name on the Visa is actaully needed. When you get married, your marriage certificate plus the expired K1 plus an AOS NOA1 proves you're still lawfully present as long as the name on the K1 matches who you married. If that makes any sense. Basically the marriage certificate has to match both names on the visa to be lawful. If a K1 visa marries someone else they aren't legally in the USA.

11-03 11-07 11-11 and 11-13 EAD touched.

11-15 Day 123 (Day 68 since the RFE) EAD approved 11-14 email! AP still waiting.

11-16 10 AM Aos approved, 2 weeks to the green card we hope!

11-16 2PM EAD card in the mail.

11-17 Email "Welcome letter"

11-20 Welcome letter in Mail

11-27 Another "Welcome" email dated 11-27, changed from 11-17

11-29-06 GC in Mail, Were done for 1.75 years!
