We applied for tourist visa first, BUT it's NIGERIA. He was denied, because they realized I was US citizen and said that he could not prove strong enough ties to his country. He said that there were some who were approved, but they had round trip tickets. So you may want to try that, but it may very well be a waste of money and a blow to you both if you're denied.

would our k1 application be denied if my fiance applies for a toursit visa first?

im wondering if she gets denied then our k1 visa will also get denied. all were trying to do is see each other. she as kids back home that she must return to.

just curious if anyone has gone through this.

a tourist visa denial should not affect a K1...but it's probably a waste of time and money because the VOs will assume (correctly) that your fiancee will have the ever popular mind change after arrival, get married, file for AOS and then file for the children...happens all the time....and round trip airline tickets do NOT prove that a person will depart the US when they are supposed to...they have no legal hold on anyone.

Pointing to children left behind as the absolute reason why somebody will return will not work....why? People abandon their kids all the time to run off and get married to an Amcit...and I believe there is a reference in the regs that specifically addresses this issue...in that 'offering to leave a spouse or child behind as means of guaranteeing the alien's departure will not overcome the presumption of immigrant intent..' (or words to that effect).

If said children are under 18, quite often the new American spouse petitions for them as well...so they stay behind for a while, but eventually (assuming the AOS is approved) they arrive to rejoin their mother...that is why such an offer has no value.
