has anyone applied for a k1 with children? do the children need to be present at interview?

my fiance has 2 kids. we are planning on filing k1. and hopefully they will get k2 visas.

she will come to us first. then once we settle down get all furniture and place ready. we plan on bringing the kids.

just curious. if k1 is approved. do all visas come in 1 packet that is sealed? or do they come in separate packets via dhl.

Yes, we did both a K-2 and a K-2 to follow. The Kiev consulate requires only children over age 14 to attend, Moscow requires ALL applicants. Check with the consulate.

Also depends. If they have separate passports, they come in separate envelopes, if the children are listed in the parents passport, as is required in Ukraine for children under 16, then they come in one envelope but with two separate visas in the same passport.

Thanks for the great info. fiance will be going to juarez. per juarez forum. it says A passport valid for travel to the United States and with a validity date at least six months beyond your intended period of stay in the U.S. (unless country-specific agreements provide exemptions)

so im assuming that both kids will have separate passports. unless they are all listed under mothers passport.

Don't assume anything. Whether they can be in her passport or not is a matter of Mexican law. If they can be, and are, then the consulate will accept it, it is a valid travel document.

In Ukraine, the children are lsted in the passport, have photos and ID pages, just like the parent and MUST travel with the parent. If this is the case in Mexico then they will have to be in her passport and she will have to go there to travel back with them, which means she also needs to have her green card or AP before returning.

Find out what the rules in Mexico are about this. Before filing our petition I went with Alla to all the necessary agencies in Ukraine, gathered all the documents and we had the children added to her passport (by the time the oldest came he had to get his own passport anyway, he was over 18) we did not file the petition until ALL the necessary papers wer in hand to complete the process, which ever way it went. You may also need permission form the father for them to recive a visa, check on that also. We defintiely had to have that and did so before we started down the road.

The K-2 MUST be issued within 1 year of the issuance of the K-1 so you do not have all the time in the world and it is not as simple as "setting up furniture" and taking a spin back to Juarez.

Easy way to tell? Check Mexican passport laws.
