Hi Guys,

Just want to get ideas about Adjustment of Status of K2's. Well my children are not with me yet but part of the I-129. so hopefully soon we will have them scheduled for a USEM interview. But my concern is not about that. Well, maybe partly...let me raise this questions :D

1. From the approval of our I-129f they should be able to apply for an interview and get approved w/n 1 year ( right? - well - anyone can correct me if I am wrong ) So, If incase the expiration of the approval of the I-129f NOA2 is on Feb. will it be ok to schedule the interview a month before February ( January )?

2. What's the condition for K2 in adjustment of status?

3. How much is the fee and what does a K2 apply for other than the AOS? I heard they also need EAD, is there fee for that? I read the USCIS site and it says there that EAD is free when filed together with the AOS ( correct me for that if I wrongly interpreted it )

4. Any more advice is highly appreciated. PS - I hope the answers comes from someone / anybody who really went through the ACTUAL k2 visa process. Sorry I don't mean to be rude to anyone, but soemtimes mere speculations are adding more complications than it should be. Tho, I appreciate if they provide a valid evidence / documentations / links to support their statements :D

The NOA2 date is meaningless at this point. K-2s must apply for their visas within one year of their parent's K-1 being granted. Period.

You would schedule to have this interview for them before the one year date.

2. What's the condition for K2 in adjustment of status?

Huh? They have to adjust status just like their parent did; depending on their age, their application cost may be less. Read the instructions.

Read the instructions......no fee for the EAD and AP if filed along with the 485.

We did a K-2 and it along with the mother's 485 was a walk in the park.
