Hi all,

I am not sure what forms I need to fill out for K-2 AOS. I am using the following forms to apply for her mother (K-1) AOS:

1. G-325a

2. I-864

3. I-485

4. I-765 (optional)

5. I-131 (optional)

Can someone point me to the right direction with K-2 AOS please?

Many thanks in advance.

Nhatrang.

8-30-05 Met David at a restaurant in Germany

3-28-06 David 'officially' proposed

4-26-06 I-129F mailed

9-25-06 Interview: APPROVED!

10-16-06 Flt to US, POE Detroit

11-5-06 Married

7-2-07 Green card received

9-12-08 Filed for divorce

12-5-08 Court hearing - divorce final

A great marriage is not when the "perfect couple" comes together.

It is when an imperfect couple learns to enjoy their differences.

The link does not help. That is why I get confused and really need help.

My Fiancee (k1) and her daughter (k2) got to USA on 08/22/2006. We got married on 09/11/2006.

I am applying AOS for both of them. Do I need to fill out the I-130 for k2?

Many thanks in advance

nhatrang,

I-485 is the application for adjustment of status. It's instructions for what to include for the different types of applicants are quite clear.

For the avoidance of confusion, I-765 and I-131 are dependent on having an application for adjustment pending, but are not part of the application for adjustment and so should not be included in a list of 'what I need to apply to adjust status'.

Yodrak,

Thank you for clarification. So I will need two set of these forms:

G-325a

I-864

I-485

One for my wife and one for her daughter. I DO NOT need the I-130. Correct?

Also do they each need two passport photos or four passport photos?

Regards,

Nhatrang

Nhatrang,

Correct, you do not need the I-130. But I see that you still haven't read the instructions.

Yes, send both applications in 1 (sufficiently large) envelope.

If the child can sign her name have her do it, but otherwise have the mother sign it like this:

What I did is tie a different colored ribbon around each application packet and then rubber bands around both.
