Hey Everyone! My Fiance hasn't filed 2010 taxes and will the 2010 W2's, 6 paystubs and an employment letter be suffice at London Emabssy. Is the tax transcript really required if there are W2's and pay stubs...

PLEASE HELP!!

July 11 2011 - I-129F Sent
July 14 2011 - I-129F Received at Dallas Lockbox
July 21 2011 - NOA1 Received (dated July 14th)
Oct 13 2011 - NOA2!!! biggrin.png (NO RFE's)
Oct 25 2011 - NVC Received
Oct 26 2011 - Got Case Number
Oct 27 2011 - NVC Sent Case to London
Oct 31 2011 - London Received Case
Nov 11 2011 - Recieved Packet 3

March 18 2013 - USCIS received date.
March 25 2013 - USCIS notice date. Receipt #MSC1390000000.
April 13 2013 - RFE Received for Copy of Birth Certificate.
April 18 2013 - RFE Replied.
April 23 2013 - Biometrics.

May 28 2013 - EAD Approved
May 31 2013 - Card production ordered.

June 3 2013 - Card Mailed, expected delivery date June 5.

September 25th 2013 - Became an official resident!!

October 5th 2013 - Green Card Received.

August 24 2015 - I-751 for Removal of conditions received by California Service Center.

August 24 2015 - NOA Receipt Date.

September 24 2015 - Biometrics.

If your fiance owes money to the IRS for not filing, it could be a point they'll bring up to question.

As I understand it, he should also give you the previous 3 years' returns (preferably transcripts).

*Started the AOS process a bit late cuse I'm a slacker and suck

But, we've had no issues. It's coming along. Interview should

be shortly coming. Married life is great*

Your interview is in 7 days.

It would be normal for the Consulate to ask for 2010 Taxes returns.

There is a reason he did'nt file so IMMEDIATELY ask him to Fax an Explaination for your interview.

It's not to late to get them Taxes done and if he owes a payment plan can be arranged before your interview.

It is highly likely that London will approve an I-134 based on pay stubs and employment letter alone if the income is adequate. A tax return is not an absolute requirement in London. They don't ever ask if you owe the government taxes. He will however 100% need his 2010 before you file AOS to get your greencard. Or if you file after April 15, 2012 the 2011 tax return will be required as well as money figures from 2009 and 2010.
