Hi.. Im preparing to submit a fiancee visa petition for my fiancee who currently works in saudi arabia for almost 4 years now. He is a filipino citizen. He will be going home to the philippines on february. The question are:

1) With the G-325 there was a question for his last residence within the last 5 years. We are not sure which to put. is saudi arabia considered his residence?

2) Since he is currently in saudi arabia and will be going back to the philippine on feb. can i go ahead and file the petition right now so by the time the petition reach the manila, philippines consulate he will be home?

Thank you!

just a heads up.. he will need a police certificate from Saudi, as well as from the Philippines when he has to be interviewed in Philippines. You need to really read through the guides as you will be needing forms signed by him.

Hi. thanks for the heads up. I actually asked him about the police certificate because i read it somewhere that its needed. He said that at saudi arabia they dont have police certificates and there is now way he's gonna be able to get that. they only have their iqama id. so im quite confused with this as well.

ive read this at http://travel.state.gov/visa/fees/fees_5455.html?cid=9727#docs, so does this mean that when he goes home on feb for good in the philippines he wont be needing the police clearance anymore because it is only obtainable when you still reside there.

although right now he is still at saudi it will be hard for him because he lives at al qatif which is about 7 hrs drive to riyadh where he needs to personally file a request for the clearance. he dont drive and he only has 1 day off from work.

Police Records

Police clearances are available for Saudi citizens and resident third country nationals. Saudi citizens currently residing overseas must return in person to process the police clearance.

Saudi citizens and third country nationals residing in the Kingdom process the police clearances by first obtaining a police clearance request letter from U.S. Embassy Riyadh, U.S. Consulate General Jeddah, or U.S. Consulate General Dhahran. This police clearance request letter, signed by a consular officer, must be attested by the Saudi Ministry of Affairs (current fee is SR30). The applicant must then appear personally with a passport-sized photograph and a national ID or residency permit at the regional Criminal Investigation Department for fingerprinting. Fingerprinting for women is done in a separate room. The police clearance should be available for collection after a week or two.

1. yes. she will also get the NBI once she comes back in PI.

2. yes. is it k-1? k-1 will be approved in 3-6mos. once she comes back to PI she will still have time to get the rest of the requirements for her interview.

From your link:

Police clearances are unavailable for third country nationals who no longer reside in the Kingdom.

That's why the U.S. Embassy Manila doesn't require them.

Yes that's correct.

If you file now, he has to get a Police clearance.

yes you can go ahead and file the k1 visa and yes he can get a police cert as long as he request it before leaving saudi arabia. thats what a fren of mine did. i was in saudi too but i was able to waive it becoz that was long ago and i no longer reside there so theres no way for me to get one.

Also make sure that when he moves back to manila to update your address at the USCIS so they wont be sending your packet to saudi US embassy once its approve like someone in this forum had.

Can he just write US Embassy Manila's address in the I-129F instead of going through that B.S? She seems sure that his fiance is going back home in February.

thanks :) But it look likes i need to file first because in order for him to get a clearance he needs to have a pending case and a letter from the US embassy requesting a police certificate. Exactly how did your friend get the police cert and how long did it took him? what's the procedure?

Not sure how it works but the list of the things that your fiance needs to prepare which includes police certificate will arrive like weeks after your NOA2.

NOA2 takes place like 3-6mos after filing of application. He should be in the Philippines by then. Let's ask Zharren Young's friend.

i have another question from the time the petition reaches the manila consulate, how much time does he have to process the paper? im just worried that he wont be able to get the police certificate in time if he have to wait until he comes home in the philippines to get it? Besides you saying that it takes about 3-6 months for the paper to reach NVC. im also worried because he said his employer won't let him skip work.
