Greeting fellow VJers,

I'm in the process of filling out the I-134 form but have a serious question and was wondering if I can get an answer. I'm currently unemployed, so I asked my cousin to do a co-sponsor on my behalf since his income is above the 125% rule. However, I just found out that he already signed a co-sponsor on behalf of someone else earlier this year. My question is will the USA consulate accept his co-sponsoring on my behalf if he had already did an earlier co-sponsor for someone else? Any help in this matter is greatly appreciated!

He can still co-sponsor if he qualifies. He will need enough income to be above the 125% poverty level for himself, any dependents he has, the other immigrant he sponsored plus your fiance.

There is no rule against a person co-sponsoring more than one immigrant. That's the good news.

bad news? The former immigrant he sponsored still counts in his family size PLUS your fiancee PLUS hmself PLUS any other dependents. That could be a problem depending on his income.

Next problem? SOME consulates (you do not say which you are using)would see this as a red flag as a person that is sponsoring people to avoid normal immigration processes. Be very sure what you are doing before you try this.

Wow thanks for such quick replies you guys...my visa goes through Vietnam consulate. The reason why I may have to use my cousin anyway to co-sponsor is because all other people I know are currently now not working, weird huh.

Even if you have a co-sponsor, the petitioner still needs to complete and sign the I-134, plus provide tax returns, pay stubs, W-2's etc... If you did not have employment due to being a full time student you will need to write a letter to that effect.

YOU need to fill out the form as well.

Okay, thanks so much for the information, my last tax return was in 2009, so do I have to submit this as well or just state that I'm a full time student and write a letter for it? Also, do I have to request the school for the letter to prove that I'm a full-time student? If you have a letter from your university stating you are a full time student that's great, otherwise a copy of your student id showing full time status will suffice. I would send the 2009 tax return, as well as a letter stating you did not file a return for 2010 due to you being a full time student. That should be all you need.

Just make sure you have ALL the required documents from your co-sponsor.

If you have a letter from your university stating you are a full time student that's great, otherwise a copy of your student id showing full time status will suffice. I would send the 2009 tax return, as well as a letter stating you did not file a return for 2010 due to you being a full time student. That should be all you need.

Just make sure you have ALL the required documents from your co-sponsor.

Anybody else want to share their experiences regarding this matter? I received the NOA2 and I am applying for K 1 visa going through Vietnam consulate, and I want to do it right the first time so that I don't mess up time wise...any input is apreciated

Gary pretty much hit the nail on the head with his answer. While there is no rule against a co-sponsor sponsoring more than 1 beneficiary, they must have sufficient income for their household, the first beneficiary and now also, your fiance.

The Consulate MAY be suspicious that your co-sponsor has sponsored more than 1 person, especially in such a short amount of time.

You may be suited to have a different co-sponsor lined up to alleviate the Consulate's suspicions.
