Lost in AP process...

I have sent my application for AOS along with I 131 and I765..was received on September 19th

I received all 4 NOAs 2 days after.

Then on November 3rd, I received letter for biometrics which I did the following day as a walk in. It was only for i485 and i765 . The IO there asked me to do another take for I131 after I asked him a question when I was leaving.

I made an info pass last Friday to request expedite or emergency, they refused, saying it has to be death or life matter.

So I called uscis the same day, and requested expedite on my case. Said they will get back to me withing 5days...to put everything on my side, I contacted senator's office and they put an inquiry too...Not hearing anything, i called now uscis, and they said my request has not been assigned to any officer yet and that I should call Monday...

What should I do? Can I do another infopass and ask to speak with a supervisor?

Just wait and see what happens..?

I need to travel abroad and cannot wait till dec 19th and then find out that my case is still taking time...

You can try another Infopass but AP is generally not expedited except in emergency. That's part of the process that you're expected to know going in.

AP and the EAD will normally take 2-3 months. Biometrics isn't needed for AP but if you are getting the new combo card (most likely) it is since the EAD requires it.

You don't say why you need an expedite in your post.

Unfortunately if the reason you want an expedite for doesn't fit their criteria, they won't grant you one. You wanting to travel for personal reason is not enough. If a family member is suffering a terminal illness or undergoing major medical treatment, you might have a shot.

@ ceadsearc: So I can make an infopass appointment even if I just went 2 weeks ago, and they said no? Since my case is still not assigned, I m worried it will be beyond that 3 month window..especially that my biometrics were not scheduled until after I called and put a service request, so I got my the appointment letter 6 weeks after I filed.

@ SF2007: I am not applying for an emergency AP.. I know it needs to be a terminal illness. Though I ve read of people here on VJ who got an emergency AP to go attend their sibling's weddings...it all depends on the IO's discretion in interpreting the humanitarian reason..and I don't want to travel to attend my brother/sister wedding, but mine actually:)

As far as I know, there's no limit on Infopass appointments you can make. You can always go and try your luck again, but chances are they will see that you already asked and were denied, so I wouldn't hold my breath.

You may still get your AP in time, though. You've already done biometrics for the EAD, which comes in a combo card with AP now, and biometrics isn't required for AP. Generally, it'll take 2.5-3 months to get that card - even if your office is moving slowly and your interview takes longer. Given that it took about 6 weeks for your biometrics, though, it doesn't appear your office is moving too slowly anyway, 6 weeks is within the normal range. But regardless - your office moving slowly or your case not being assigned should not affect how long your AP takes.

I received 2 emails today ..one for the A/P saying it has been approved, and they mailed a notice today.

and another one for EAD saying production has been ordered, please allow 30 days...

another question...can't help it, how long should I wait till I get it?

Since it is based on an expedite request, can I call them to ask to send it overnight..with me paying of course?

ps: I had called again yesterday uscis, and they said that it was still unassigned..this time, the lady on the phone seemed very comprehensive and gave me a fax number to send whatever documents I have with a cover letter.I think this has helped..or maybe contacting the senator's office last week? or both?

If your initial expedite request was denied it may have just been that this is when it would have been approved anyway. I've never heard of asking to have it rush shipped, but I suppose you could call USCIS and ask.

When are you leaving? It will normally only take 7-10 days to receive. However, what you can do is make (another!) Infopass appointment, tell them that your AP has been approved (it should show in their system) and ask them to print something out for you if it looks like you won't receive it in time. This isn't asking as much (and thus is more likely to be approved) since you have already been granted AP.

I got my travel document today .not the combo card though, as I guess they accepted to expedite..so the combo will come in its normal time.
