Hi all,

So, here is my situation - my NOA1 was August 11th... I am the US Citizen and 6 months pregnant. We are currently living in Asia, but I will be moving back to the US on January 4, baby due March 6.

My husband will be flying with me to California to help me set up for the baby. But, since we haven't received the NOA2 yet, I don't know how to time his flights. He was already flagged once going into the states because we hadn't bought his ticket to Asia yet and they just about flew him back to Portugal (they took him to the office and everything). But, after some finessing, he talked the guy out of it and 10 days after he arrived in the US, he left just as he promised to go to Asia. So, hopefully he won't get in trouble for entering the states again.

Assuming that the NOA2 arrives in January (within the 5 month processing time estimate from USCIS), then how long should it take to do the process back in Portugal?

We don't want him to miss the birth of our baby, so I was thinking of either:

1) He flies back to Portugal at the end of January... hopes the NOA2 arrives, and flies back at the end of February (hoping our baby doesn't come early!!!)

2) He flies back to Portugal in April - well after the 5 month processing time estimate, and take care of things then.

I need to buy a ticket before we enter the US so he can show immigration that he plans to leave, so I am feeling the pressure!!!!

Once the NOA2 arrives, and case will be forwarded to NVC, it takes up to a month to generate the case number, AOS invoice, etc. He can take care of all next steps while he is in USA. :-) No worry! But interview would be schedule in his country. If he wish, he can make some delay to submit the doc to NVC to ensure that he gets the interview date when he gets back to his country.

may be, you can consider to book his book for April. It will be managed easily.

I think you're right about April - then we don't have to worry about if I give birth early, and after the baby is born, I'll be home on Maternity Leave, so it'll be okay if he leaves for a couple of weeks.
