So my aunt and uncle have been married for 10 years, my uncle, a LPR petitioned for my aunt and she became a LPR 2 years ago. Now if he were to apply and become a U.S. citizen in the next 6 months does my aunt qualify to apply to be a U.S. citizen after the 3 year period??

thanks!

She'll have to wait 3 years after he becomes a citizen. That's the earliest she can apply unless she applies on her own based on being an LPR for 5 years.

Your uncle has to be a US citizen for 3 years until your aunt qualifies. It looks like in her situation it is easier and faster if she applies on her own based on 5 year residency since she will qualify in 3 years anyway. It is both faster and she will require much less documentation when compared to the 3-year marriage application.

"I have been a Lawful Permanent Resident of the United States for at least three years, and I

have been married to and living with the same U.S. citizen for the last three years, and my

spouse has been a U.S. citizen for the last three years."

Meaning you have to wait five years if your husband was a LPR when you got married. Could do it together, but no family discounts.
