Hello,

I am an American Citizen and I need immigration visa advice for my wife. I married my Japanese wife here in Japan in June of 2009. We have already had our first interview April 4th 2011 at the U.S. Embassy in Tokyo for approving the I-130. We received a letter in the mail from the U.S. Embassy saying “Congratulations! Your immigrant visa petition has been approved.” April 14, 2011” (I’m assuming that means we can safely move on to the second interview). We scheduled for our second interview which is coming soon (November 29th).

We are currently both living in Japan as English teachers. I plan on moving back to the U.S. around the beginning of next year 2012 (Jan-Feb) to look for work. The plan is for my wife to come to the U.S. after her work contract expires at the end of March. We will be living with my parents who said they can help us financially until I can get on my own legs to support my wife.

In particular, I need help filing out the I-864A/I-864. I have searched for advice online but cannot get a straight answer, I want advice concerning this situation.

As I will not have a job right away when I arrive to the U.S., I will need to depend on my parent’s income. I’m confused to who completes which form. Do my father and I both complete I-864 form? Do I complete the I-864A or not?

In the case that both my father and I fill out separate I-864: in part 3. number 8, do I select "Yes" and WHAT does my father select? Yes, no?

Do I fill out the I-864A also?

Please help..

You complete an I-864 as the petitioner. Dad completes an I-864 as well.

In your scenario an I-864a could be used by one of your parents if they need to combine income.

If only one parent is needed as a joint sponsor then it's an 864 from you and an 864 from your Dad.

In your scenario an I-864a could be used by one of your parents if they need to combine income.

Thank you, you're really great help. I am in the middle of filling out the 1-864, I have a few questions:

1. On Part 4 Information of the sponsor, on my form do I put my current Japan address or future address (parents home address)?

2. Part 5 Sponsor's household size: do I write 3? and does my father write 3 as well? (He is married and they live together).

I think I may have found the answer to my first question about what address to write (this is from i-864 instructions):

"If you are not currently living in the United States, you may meet the domicile requirement if you can submit evidence to establish that any of the following conditions apply:

B. You are living abroad temporarily. If you are not currently living in the United States, you must show that your trip abroad is temporary and that you have maintained your domicile in the United States. You can show this by providing proof of your voting record in the United States, proof of paying U.S. State or local taxes, proof of having property in the United States, proof of maintaining bank or investment accounts in the United States, or proof of having a permanent mailing address in the United States."

So I'm assuming that as I'm attaching my tax return transcript showing the my last three years anyways, this is taken care of?
