hi i had interview on 10/25/2011, they didnt ask so many questions and we were together interviewed, only problem was about the bank statements coz i had like 3000$ on it in september but that s money from my family for the wedding and also i was working on J1, anyway after the interview they keep my bank statement, and phone bill they gave me back my passport and i didnt sign anything they told us they needed more time to investigate and they will let us know in 2 months.

what does it mean and what should i do will they follow us everywhere, if someone has expirience with this situation please let us know thanks in advance everyone

The case has been put in A P for further review. This can take from two months to a year. You need to give more info about the circumstances to get an acurate answer.

If you suspect someone is following you go to the local police. The U S govt doesnt follow people unless they think you are a spy or you have stumbled into a movie set by mistake.

Thanks for your answer, on that day I think my husband was so nervous, so when IO asked him what kind of visa i had before, he answered J1 visa and then IO asked him, was it for studying? he said yes, and actually it's not for studying, its for working only! i think probably have problem with my bank statement become I am not working since August 2010 till the day I got EAD on 22 Sep,2011 but we explained for IO that the money from our wedding and I worked before too, so we have a little bit in saving! IO just said wait, they need to investigate more, and they will mail us in the future, maximum it can take up to 2 months, I'm so confusing after that :(

I don't think it was the bank account. Our bank letter stated that we had a little over $3000 in over account, the IO didn't ask anything about that. We thought our interview went well and we were hoping to hear we were approved on spot. Instead, we got a paper stating we should wait 90 days for a response. One week after that, we got a letter sending us to a stokes interview.

Not saying the same thing will happen to you but just hang in there and think positive, you just might hear something next week. I know how confused and frustrated you must be.

What your husband did wasnt perfect but its not so bad either. I think the problem is about the support issue. The money in the bank is good but that isnt going to help in the long run.

If you didnt have a co sponsor you should find one. Be ready to give the embassy more support evidence. If this is correct do it as soon as you can. Its not good if they send the case back to the USA for review. Try to do everything you can to have it decided at the embassy. What support info did you give them? You not working is going to be a problem for sure.

Two months max would be good & bad. That can turn into anything & I know this is very hard to endure. Try to cut that time frame down by finding out what the situation is.

To answer the original question, if indeed you are talking about an interview for AOS, many IOs do not approve applications on the spot and it is standard for them to take your documents of evidence and tell you they will review it and you will be notified in the next couple of months regarding a decision. I'm not sure what you mean about your bank statement - did the IO specifically tell you there was a problem with your bank statement, or are you assuming so because they kept it?

Typically, what will happen next is you will either be approved in the next 60 or so days, or else you will receive a Request for Evidence if the IO needs something additional before making a decision. Occasionally, as happened with Know_ledge above, you may get a second interview request if they suspect fraud in your marriage, in which case you and your spouse would be interviewed (and recorded) separately. This is uncommon, however.

To answer the original question, if indeed you are talking about an interview for AOS, many IOs do not approve applications on the spot and it is standard for them to take your documents of evidence and tell you they will review it and you will be notified in the next couple of months regarding a decision. You may be right & I made a mistake in my understanding of what the O P was talking about. I thought the refrence to the passport had to do with the issuance of a visa.

If this is an AOS situation it doesnt resemble the process I went thru at all. The RFE we got was done right then for example. We sent in the info & my G card was issued two weeks later.

I am sorry if my mistake caused any undue confusion. I hope the O P will make this more clear as to what exactly is going on.

It's hard to tell sometimes as people don't always post in the right forums, so I am only basing my statements on the assumption that OP used the correct forum.

Thanks for your all kind of attention, so right now I just need to wait, I don't think I can find more evidence for my case, IO asked me if I had insurance, i said no, because we are not working so we don't have money to get it.
