Hello,

Our novel extends from August, 2008.

We have an ongoing process I 360 (actually it was denied, we appeal was accepted and the reopening).

In recent days I received a 797C saying "After review, we have Decided to treat the appeal filed in the above case as a Service Motion to Reopen or Motion to Reconsider Service. You will receive a notice under separate cover once all action has Been completed. "

We lost, not knowing if we rejoiced or saddened ... they did not asked for anything, do not say time, as usual. Nothing!

I confess that anxiety "hit hard", are already many years of waiting.

I hope that some of the friends of the forum can tell us something ... give a light ... anything!

Your post is very vague, if you want 'light' you might want to give us insight into your case

What visa? On what grounds was the denial? On what grounds are you appealing?

Before all I would like to thanks for you attention.

I tried to be more objective possible, for this I did a summary only. Here are some details:

Process type: I360 PETITION OR SPECIAL IMMIGRANT FOR AMERASIAN, WIDOWER,

Open at April 14, 2008

Denial: june 19, 2009

Appel: I290B, NOTICE OF APPEAL TO THE COMMISSIONER

At july 21, 2009

Result: Aproved at january 11, 2011

They requested more documents and we sent to them.

In our page at US Imigration site it became: (Request for Evidence Response Review)

"On May 2, 2011, we received your response to our request for evidence. This case is being processed at our CALIFORNIA SERVICE CENTER location. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. We will notify you by mail when we make a decision or if we need something from you. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use the processing time information on our website to estimate when this case will be done."

At October 12, 2011 they sent us I-797C, Notice of Action saying "After review, we have decided to treat the appeal filed in the above case as a Service motion to reopen or motion to reconsider. You will receive a notice under separate cover once all action has been completed. "

In our page at US Imigration site continue "Request for Evidence Response Review".

Waiting for your answer.

You know, I don't know much about that classification of visa, but it sounds like you just need to wait now. Would you like to explain your case in more laymans terms - not just cut and paste from your notices?
