After all of our waiting we found out our packet has been lost. We got out approval on 2011-09-19. I did not know to call the NVC to get the data so we could expedite the process. Well Yesterday after waiting 36 days and no embassy letter I called the NVC and was told they do not have our packet. So I waited until 8 AM local so I could call the USCIS and was told they have a record of it being shipped to NVC. Well I submitted official inquires with both agencies and got back a response explaining that NVC has searched all documents and they are not in possession of our packet. USCIS has sent me a response that they will expedite our case. This all being said we were trying to have her travel on 1 DEC but it does not look good with this current mix up.

Does anyone have any advice of how we can make this process faster once we get the notice that NVC receives our packet?

Lastly I am worried because the I129F is only good for 90 days and they have wasted 36 of our days to get it complete.

We truly appreciate any help.

Your packet wasn't lost, your packet wasn't sent yet. We ran into the same thing. Many cases are taking over 30 days after NOA2 to get sent on to the NVC. After the NVC receives it, call daily asking if they have the case number assigned yet. Once the case number is assigned, you can pay for the interview, then get the date set. While you're waiting for the date to come, get her to her medical. You want to try to get that done early, so there is enough time for it to arrive at the embassy before her interview. Get the CFO out of the way to, so she just needs to get the stamp after she has her visa.

We did every thing we could to rush our case to. We wanted to be together after all. It worked out and all our tight timing worked out. But it was rather stressful trying to rush everything. BTW the 90 days starts counting when she enters the country. She had until February to actually fly here and our NOA2 was June 28th. But we did know many couples who did not get their visas in time for their hoped for flights. If I had it to do over again, I might not have tried to set the flight so close to the interview, we were pretty lucky ours made it in time. I'm pasting our NOA2 thru departure time line, maybe it will help you out in planning. Do not get an airline ticket you cannot change, because our time line is probably close to the fastest you can hope for. Like I mentioned, we knew others trying to do the same and it took them a couple weeks longer before visa was in hand.

Thanks so much for the advice. On the lost part the USCIS told me that they have a record of Vermont sending the packet. They informed me that they would send another copy because the first one did not make it.

On the 90 days I am concerned because the NO2 states that the approval is only valid until 18 Jan 2012.

Again we will post any updates as we receive them.

At this point, I wouldn't worry about it. in my situation the NOA2 expired on Nov 30th. the interview was scheduled before the expiration. the interview date was Dec 13th. the Embassy automatically revaildated the petition. if you are unable to schedule an interview date before the expiration, contact the Embassy and ask for the petition to be revalidted.

Well we called USCIS and asked for an inquiry as to the status of our packet. They returned a letter granting us Expedited service. We made the first call Monday 24 Oct and by Thursday the packet was in NVC and we got our MNL Case Number!!!!

We just hope ad pray we can still make our 1 December target.
