Good news: we're scheduled for an interview at Montreal!

Other news: We'd like to reschedule.

Question of the day:

After lying stagnant for a year, a petition is revoked. When does that 1-year period start - when the I-130 is filed, when the visa application has been approved, ?

Reasoning:

I've got a job in Canada that goes through Aug 13. We'll re-schedule our interview so that my job expires before the visa expires.

HOWEVER:

It's possible that my time here will be extended by a year. It's been suggested that I stretch out the process as long as possible, so that my petition isn't revoked & we have to start over from square one - because apparently, a petition is revoked after 1 year. When does that year start?

8 August 2009 - Met

21 October 2009 - Started dating

18 August 2010 - Engaged

22 January 2011 - Married

15 March 2011 - Filed I-130

22 March 2011 - NOA-1

With NVC, that year starts from the last date of communication from NVC to the beneficiary/agent. But since you're through NVC already, I suppose it would be last date you contact the embassy?

One question for you though.. why not, after rescheduling the interview, you have it, then maybe take a vacation from your job and activate said visa? (Note, iirc the visa is good for 6 months from issue, so it wouldn't have to be immediately when you get visa in hand..) Then apply for a re-entry permit and go back to work in Canada, moving your stuff then (as you have a year from visa activation to move your things duty-free).

And if that didn't make sense, sorry.. getting up at 6am scrambles my brains for the rest of the day. :P

This is a question for the Consulate. The one year issue is for while the case is at NVC. I would just email the Consulate in Montreal indicating you would like to delay the interview due to a new job you can't resist. Ask them how long the interview can be delayed without having to start over again?

Facts are cheap...knowing how to use them is precious...
