hi everyone!i entered US on a k1 visa and i traveled together with my son who is us citizen thru CRBA. when we applied for his CRBA and US passport his surname is still my surname(single)when they issue us his crba and us passport since we were not yet married by the time that our son was born. Now my question is,HOW COULD I CHANGE MY SONS SURNAME TO HIS FATHERS SURNAME?Since he is still using my last name as his mother in his US passport,and crba?would that be possible?how is the process and what office are we going to go so my son can now legally use his dads surname. By the way,were now married with his father here in the USA but not in the Phils. thank you

You should have given the child his father's last name at birth. Now you will have to look at the laws in the state where you live and legally change his name before you can get anything changed to use the father's last name. Where I live it costs about $500.

If you are married in the US, then you are also married in the Philippines. You cannot be married in the US and single in the Philippines at the same time. Since you married in the US, you are married in the Philippines. (I don't know why people think if they are married in one country, they are not in another. This is the second time this week that this has come up on this forum.)

To change your child's last name, you need to get a court order. This is the only way. The Social Security Administration and the US government will not accept another name without a court order.

Google your local Superior Court to find out how to legally change your child's name.

Actually in the Philippines if you marry abroad you mist file for Judicial recognition of Marriage Abroad before the NSO (National Statistics Office) acknowledges that you're married

While I agree with the semantics of you statement as it is technically correct, in the Philippines legally speaking it isn't...

well when my son was born his dad who is now my husband were not yet married before in the phils.And the law in the philippines states that born out of wedluck cant carry the fathers surname and that was what happened to my son.Then when he filed a fiance petition to me,the CO require me to apply for my sons CRBA and US passport since his father who is my petitioner on k1 was US citizen already when he is born.And when i received my sons crba and us passport its still on my surname even his father who my husband now signed an affidavit of paternity and support.But the legal name of my son is on my surname not on his fathers surname bcoz he was born out of wedluck.

His father and I were not married in the philippines only here in the US that we got married.We wish to change our sons last name into his fathers surname but we didnt know about the process.....on how and where will we go.

My sons CRBA,US passport and birth certificate is on my surname(mother).Is there a possibility that we change it?thank you

The responses you received when you asked the exact same question yesterday are still valid today. You need to pay to legally change the child's name. Contact your local courthouse to get the exact process and cost.
