I was told by a lawyer once it does not matter what country my fiance is in we can still file for a K-1 visa. She is from the Phils and is back home but wants to go to Canada for work. Can I still file the K-1 when she is in Canada. We are still waiting on the Annulment BS.

you can file while she is in Canada and she can interview there too if she is still in the country when the time comes

She can only interview in Canada if her work visa is valid. They will not interview her if her visa expires or she is not there legally.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

This is your situation when you start filing while she is in Canada.

Someone has to attend the annulment case, Annulment is nasty and expensive. The length of process depends on the case, the system and the lawyer. It could take 6mos to yearssss

If she is already in Canada, you have to notify the change of address and have to change Embassy for the interview???

If once she's issued with K-1 visa, it is valid for 6mos to fly to US. The Philippines usually use agencies work abroad. What is she going to do with the contract on the agency that sent her there and contract usually lasts 2yrs? She might be sued.

Advise. Ask your fiancee what's her priority.
