Hi

I filed a K-1 application two years ago.

My fiance had her interview in Moscow. The Embassy kept her

passport while waiting for a tax transcipt from me. While waiting

my fiance had to go to Germany for her job. She explained this to

the Embassy and they returned her passport. The Embassy then sent

our entire K-1 visa package back to the U.S.

Fast forward two years and I have filed the same paperwork for

the same woman. Only this time it is taking longer than before.

After five months of waiting you can request an update on your

status. I did that and was told that they are doing some additional

investigation and if I don't hear anything in six months, call again.

Does anyone have any advice?

It's possible that your name flagged a hit with one of the several databases USCIS accesses when doing the background check on the petitioner.

1) Do you have a common name?

2) Have you been in any legal trouble since filing the last I-129F?

If so, you may be held up for name check clearance which unfortunately can take some time. If USCIS is telling you that it can take an additional 6 months I'd bet you flagged for some reason.

Only thing you can do now is to wait - or - if you're outside of the normal processing time of 5 months you can ask your Congressperson to intervine on your behalf.

Seems to be from the 1st time you didn't provide tax documentation and that will surely delay the process. I would recommend making sure you provide all the correct documents in a timely fashion, certified mail, and tracking numbers and check w/ the Embassy in abroad.

Are you currently waiting for NOA1 or NOA2 or Embassy Packet to your fiancee? Not very clear from your post.

I would surmise that he's waiting for the NOA-2. Tax documents are not submitted at the time of filing the petition, so that likely has no impact on his delay this time around.

I had a similar situation. It took 9.5 months total before they finally approved us - even with the intervention of my congressman and USCIS ombudsman. I can't give much advice, but I can commiserate! I hope you will get it faster!

2009/06/19 - 1st NOA 1 (I-129F)

2009/10/07 - NOA 2

2010/01/11 - interview; result - approved

2010/01/18 - received passport with visa in the mail

2010/02/05 - embassy calls and asked to return visa for a "correction"

2010/02/09 - fiance returns passport with visa to embassy

2010/03/09 - embassy tells us we are in "administrative review"

2010/09/07 - fiance receives passport back with canceled visa and letter; our petition has been returned to USCIS

2010/11/08 - 2nd NOA 1 (I-129F ROUND 2)

2011/04/19 - service request response - 6 months additional extensive background checks

2011/08/22 - 2nd NOA 2

2011/10/04 - interview

2011/10/20 - visa received

2011/11/04 - POE

2011/11/25 - legal marriage

2012/07/21 - wedding with family and friends!!
