Hi guys! I'm a little worried about my case. Maybe anyone can shed light.

So I have a B2 visa expiring Nov 18,2011. I will be appearing at POE 3 days before that.(Nov 15) for a plain 2 wks vacation and Thanksgiving. (I have a sister in NYC but my POE will be in los angeles.) So I thought this might not be a big deal since it was pretty clear in the US immigration website that i can apply for entry even to the last day of the visa expiration. But then I just learned from my fiance(who is a USC) that he filed for K1 2 wks ago. This was not our previous plan. He wanted to surprise me or something?! Initially, we planned to apply end of this year or early next yr. Now, i have apprehensions that i might be denied entry due to this and the other (visa expiring) could also add to the "red flag".

Anyone with similar case?

Well even with the visa you never guarantee an entry this is sole discretion of the CBP officer.

How are you planning to stay 2 weeks if your visa is expiring 3 days after arrival? I am not even sure they will let you in.

What got me confused how is your fiancee filed K-1 without you knowing it. There are documents that you have to fillout and sign, did you do it?

Erm.. How could he apply for a K1 without you knowing? The application requires several forms with your signature.. I find that a bit weird, I have to say.

In any case, it'####### or miss with the B2. The expiration date doesn't matter as long as you enter the US before that date, your I-94 will tell you how long you can stay. Obviously you would need a new B2 to return after this trip. Whether or not you are let in is in the hands of CBP. You should bring plenty of proof of ties to home country and be ready to show that you are planning to go back home. Your home country can also have an affect on how easy/difficult entry will be with a pending K1.

06/14/2011 - Day 103 - E-mail notice: Interview letter mailed, interview scheduled for July 20th

07/20/2011 - Day 139 - Interview at Federal Plaza USCIS location

07/22/2011 - Day 141 - E-mail approval notice received (Card production)

07/27/2011 - Day 146 - 2nd Card Production Email received

07/28/2011 - Day 147 - Post-Decision Activity Email from USCIS

08/04/2011 - Day 154 - Husband returns home from abroad; Welcome Letter and GC have arrived in the mail

Ah sorry for the confusions. I have already filled up the i-29f a long time(last yr i think) ago but we held back on the submission due to some family reasons.(sick then died) By the way, i have not received anything yet(him too) regarding if it was received or not. Im just worried that I will be asked or maybe if I should say anything about it to the IO.

Thanks for the replies. Planning to bring a printout of the approved vacation leave from work and my return ticket. Do you think those would be enough?

Besides I-129F there are also other forms that need to be signed and dated more recently then a year ago. So this doesn't sounds true again.

You will need to show a stong ties back home, just an approved vacation will not do it. A letter from the employee, if you have house or an appartment show your lease. You would really need to show the strong ties back home.

Oh the i-29f is the only form i filled up. So does this mean that it was not received yet and not stored in their system somewhere? and my only worry is the B2 expiring in 3 days? :unsure:

It is possible that it was not accepted and will get rejected since not all the forms are filled out. As well as it is not you who suppose to fill up I-129F, but your fiancee.

Well as long as you can show strong ties back to your country, you should be fine at POE. The CBP officers usually don't see the information about K-1 visa, especially since nothing was recieved.
