Affidavit Of Support change and interview

Hi,

My wife (the USC citizen) recently quit her job to take care of our son. Our interview letter just arrived and it is in 1 month so I have some questions about this:

1. On the original i864 she was sponsoring me and all documents (tax returns, employment letter) were presented. Now, this has changed. I currently have a legal job and earn above the poverty line. So if we update this form, should we wait for the interview date to present it? or should we try to send it to USCIS before the interview?

2. If I am the only source of income for the i864, will a letter from my employer suffice, stating their intention to keep me after I get the greencard? I started working in last November so my last tax return would show a very little income for that year. So my only evidence would be the letter and the paystubs.

3. We could also get one of my wife's relatives to sponsor me. Would this be a better idea? We do not want really to bother them, but we will if we must.

I honestly don't know what the 'right' answer is, but I sponsored my husband and once he got his EAD, I cut down my work to part-time. Since we had already filled out the I-864 we weren't even asked about it, though we were prepared to show documentation of my husband's continuing employment at the interview if necessary.

OUR TIMELINE

I am the USC, husband is adjusting from B2.

08.06.2010 - Sent off I-485
08.25.2010 - NOA hard copies received (x4), case status available online: 765, 131, 130.
10.15.2010 - RFE received: need 2 additional photos for AP.
10.18.2010 - RFE response sent certified mail
10.21.2010 - Service request placed for biometrics
10.25.2010 - RFE received per USCIS
10.26.2010 - Text/email received - AP approved!
10.28.2010 - Biometrics appointment received, dated 10/22 - set for 11/19 @ 3:00 PM
11.01.2010 - Successful biometrics walk-in @ 9:45 AM; EAD card sent for production text/email @ 2:47 PM! I-485 case status now available online.
11.04.2010 - Text/Email (2nd) - EAD card sent for production
11.08.2010 - Text/Email (3rd) - EAD approved
11.10.2010 - EAD received
12.11.2010 - Interview letter received - 01.13.11
01.13.2011 - Interview - no decision on the spot
01.24.2011 - Approved! Card production ordered!

REMOVAL OF CONDITIONS

Thanks for the reply. At least you were still working at the same place. If the interviewer asks me where does my wife work, then I would need to answer that. I am also wondering if it comes to it if we should show the updated form at the beginning or jus after a question regarding our jobs is asked.

Hard to say, we weren't asked any questions about our jobs, actually. I'd just make sure to bring an updated affidavit of support including a letter from your employer stating that you are employed and your employment will continue, so you can give it to them if you want/if asked. I'm sure this happens on a fairly regular basis.

I would be better if you consult an attorney, but I think you can't fill an affidavit of support for yourself. My guess is that you have to find someone else.

The spouse is always the primary, even if they make nothing, but an intending immigrant can add their income to bring the amount over the poverty level as long as they can provide evidence that their job will continue after their green card is approved.
