Short and sweet...

I'm a United States Citizen petitioning for my new wife (Mexician Citizen) to enter the United States. Were at the very beginning of the process just filling out forms.

Question on form I-130 it asks HAS YOUR RELITIVE BEEN UNDER IMMIGRATION PROCEEDINGS and were not sure what to put. My Gut says NO but here is the issue.

About 2 years ago she obtained a B1/B2 visitors visa and attempted to enter the country. When she was inspected by customs she told them that she had worked in the United States in violation of law priviously, in which resulted in her subsequently being deined entry and returned to Mexico. Also they took her visa and and made her sign two documents.

Question 1. She doesn't know if she was deported, excluded, removed or rescission. I'm pretty sure neither. Anyone know of a resource that i could use to find out what happened?

Question 2. Also do you all think I should get an immigration atourney to help with my case?

if they took her fingerprints, requesting an FBI check would let you know what they have. But that takes about two months. i agree with the other VJ member..consult an attorney and see what advice they give you. But be careful because there are a lot of attorneys that will only take ur money and discourage you. If you're in the southern california area i can give you a few resources.

Just remember that immigration keeps a record of all the people who have attempted to cross the border. So you can't really say she's never tried or has never been under immigration proceedings, because they have record of her visa. My husband was in a similar situation. Although he didn't have a visa, he attempted to cross illegally and was removed. therefore in the I-130 i put down that he had been removed once.

Exactly what documents did she sign and more importantly, what boxes were checked and/or which codes were written in by hand...they will be a string of letters and numbers. Without knowing the codes, it's impossible to say whether you need a lawyer or not.

Also, please go to www.immigrate2us.net....they are the experts with these types of situations and you will get much more help than you will here.

not sure how to post in the original posting but.

1. I live in Corpus Christi Texas, anyone have a suggestion on a good atourney?

2. Was thinking about having her call the Laredo Port and see if should could get some info. Just Crossing our fingers.

3. She is unsure of anyforms that she signed and any codes on them, she does recall them taking her fingerprints though. (what she got turned away for is admitting to working for 1 month while she was on a I-94 she never overstayed)

4. Going to check out www.immigrate2us.net too.

It doesn't matter where the lawyer is--it is Federal law, and that means the attorney can take cases from anywhere--not just in your home state.

There is a terrific FREE chat every Wednesday by one of the best immigration lawyers around--she is expensive--they all are if they are handling problems--here is her link. You will need specifics, though, to get a valid answer.
