Sept 11, 2011 NOA2-took 19 days to get case number

Sept 30, 2011 NVC number and IIN received Friday-gotta wait till Monday

Oct 13, 2011 Case Completed- 13 days from receiving case number Took 32 days from NOA2

Nov 30, 2011 Notified of Interview date

January 19, 2012 Interview- 240 days from NOA1

I will use myself as an example.

I am a college student that has no income as I do not work right now. I fill out I-864. I claim 2 people on my i-864....My wife and I.

My co-sponsor is my father. I live under his residence and he is head of household. He claims me as a dependent on his taxes and he files a joint return with my mother who is currently unemployed. Dad claims 4 on his i-864.... Himself, Mom, Me and my wife. Dad's income alone is enough to qualify and meet the poverty guidelines. So to correctly show the head of household (my father) he would file i-864 and NOT i-864a. I am living under his roof that is why. I sent joint transcripts from 2008-2010, his w-2's and his job letter. I also made sure all the numbers for his i-864 reflected ONLY HIS income and none of mothers as she does not make any income currently as she is unemployed. So this should solve where the income is coming from if the consular officer has any doubts.

As you can see there are a TON of variations that can surface...be clear in what your particular case is so we can guide you to the correct paperwork to file.

Dave, I filled out an I864. I am unemployed like you and live with my parents. I am not claimed as a dependent on their taxes though. My mom filled out an I864 as well, she filed joint with my dad. There are no other dependents. This made it through NVC fine, but the CO said that I had to include my moms income on my I864, which upon reading the forms, means my mom needs to fill out the I864A since that is the only option to get her income on my I864. My question was, where the heck does my dad go? There is a box on the I864 where it says something like "this income will be compared to the poverty guidelines" but since there's now only three people listed on my I864 (me, my husband and my mom according to question 21G) it seems like it's incorrect.

I am willing to believe that the CO was confused but I just hope that the new I864 for me and the new I864A for my mom will clear this up. I am worried that my father is supposed to be included in the head count somewhere and that I couldn't find a spot to fit him in.
