Hello everyone I have been reading through the guides here (because I am bored at work) and I want to make sure that I understand the naturalization process (although hubby and I are not quite there) My husband came on a K1 visa we later married and he has his conditional greencard so naturally we are taking a break from USCIS however I like to stay ahead of the game so I know we have to remove conditions 90 days prior to the expiration date. Now as I am reading about ROC I just happened to click on Naturalization process and it says that if the beneficiary has been married continously for three consecutive years with the same spouse then the 5yr rule can be waived. So does that mean we dont have to remove conditions we can skip that part and go straight to the naturalization stage? I just need someone to clear up what I "think" I read Thanks in advance...... :thumbs:

You absolutely have to remove conditions.

Your husband can apply for naturalization when he has been married to you for full three years and has been a LPR (counting from the day he got his conditional card) for 3 years minus 90 days.

OKflyboy is correct.

First - make sure you understand what it takes to go through the removal of conditions phase. Read the I-751 documents on the uscis website and make sure you keep all documents in order... the documents are the evidence you will have to submit when you must remove conditions.

Then, once you are at the 3 years anniversary (minus 90 days), you can apply for naturalization....

N-400 Naturalization Timeline

You've missed the a requirement for the spouse of a US citizen to use the 3 year naturalization rule.

Generally, a person must be a legal permanent resident for 5 years to naturalize. The spouse of a US citizen can naturalize in 3 years if 1) been married to the same US citizen for 3 years, 2) been an LPR for 3 years, and 3) reside with the US citizen spouse for 3 years.

Your husband must have the condition from his green card removed. This occur after 2 years of being an LPR. At that time, he has not met the 3 years of legal permanent residency to naturalize.

Gotcha guys thanks u guys r so correct bcuz yes we have to ROC in 2yrs i totally wasnt thinking but then in 3yrs we can naturalize after we ROC.....thanks bunches u guys are the best!
