Timeline

My fiance has had a work visa since before I sent the I-129f petition for a K1 visa. I know it would be illegal for him to come to the USA on the work visa and get married, and then try to adjust status since we already started applying for the K1. But can anyone tell me if they know anything about if it is ok if he would come for a few months on the work visa and just stay here and work, and then go back to his home country in time to prepare everything for the K1 interview? Thanks!

If the work visa was issued prior to the K-1 application, and your Fiance has already used the work visa, what could be the problem in continuing to work?

Seems that a precedent has been set for legitimate work.

Has your Fiance entered the US with the work visa before?

Oh.

Well, that could be problematic, in that the Immigration Officer at the point of entry (POE) may believe something else is going on.

Does your Fiance have a letter of invitation and a firm "written" job offer from an Employer? That would certainly help.

No, he hasn't used the visa before and has never been to the USA.
