Hi, my wife who married me (US citizen)has had green card and lived in Seatlle almost 3 years. She went to China two month ago and plan to come back next month(Out of US for three months total). She would like to apply US naturalization after coming back to Seattle home from China. But I saw "Have lived within the state, or USCIS district with jurisdiction over the applicant’s place of residence, for at least 3 months prior to the date of filing the application" on USCIS site. Should my wife live in Seattle home for another three months after coming back to Seattle home from her 3 months China vacation to be qualified to apply US naturalization? Or she is qualified to apply immiditely after coming back to Seattle home from China? Thank you very much!

no, that's only if you move to another state, then you have to be at your new city at least 3 months, she has lived there 3 years.

nothing to do with here situation.

to qualify 3 years of being a LPR and 3 years of marriage.

Hi -

No, your wife can apply immediately. The rule is talking about if you move residence within the US, then you need to wait three months before allowed to apply.

Example - you currently live in Seattle (serviced by Seattle District Office) and decide for some reason to move to San Francisco (serviced by SF District Office), then you will have to wait for 3 months before you can apply.

Obviously, that is not your case and your wife needs to only mark on the application her travel outside the US...

Good luck!
