So my husband and I got married in May, 2007 and I came back with him to Canada. Since then, I have resided here but only with temporary resident permits and visitor records. I have been back "home" in the States a total of 2 months since we have been married. As soon as our house here sells, our 2 yr old and I are going back to live at my parents house while my husband waits/works here until he gets his green card.

Form I-130 Question 21: Give last address at which you lived together:

I will be putting our Canadian address, obviously, and from May 2007... but what do I enter for To? Present? Do I make a note somewhere that I am returning to the States in November?

Is this going to be an issue for estbalishing domicile?

If while you are completing your i-130, you are living in Canada. I suggest write down that as your present address. There is a form for you to complete if your address changes. Just keep in mind to write down the truth. Good luck.

Montreal can be very picky about domicile. Since your timeline is not filled in I do not know what stage you are at in the process. If you have moved back to the US prior to his interview that will help but you need to be well established there. Have you seen this thread pinned in the Canada forum? Proving Domicile

Yes, as I said I do intend to put our Canadian address down for question 21, I just wondered if I should note on a separate piece of paper or something that I intend to return to the US in November, when my visitor record expires here. Or do I just not worry about that now and then submit a change of address form later.

I am just so worried about not being able to prove domicile as I have not resided or filed taxes in the States for the last 4 years.

I have gathered that from reading lots of threads on here. I have looked at that one, that's why I'm a bit concerned.

I am filing the I-130 this week and am returning to the States in roughly 3 months. So, yes, I will be back there before my husband has his interview in Montreal. I will have a job, bank account,etc. in my name. I suppose I can have my parents draw up a "lease agreement" of sorts, as my daughter and I will be staying with them until my husband arrives and we can buy our own place. I have kept my driver's license current also (not sure if that counts toward proving domicile, though).
