infuriating response to service request

Timeline

So the CSC admitted end of last month that they don't have a record of receiving my 1st petition, which was returned from the embassy. So, I submitted a service request for them to look for the file, providing the exact dates that the NVC states it forwarded it to them.

Today I get a letter in the mail, dated the day after I filed the request, saying:

"WAC 09 XXXX petition 1) and WAC 11 XXXXX (petition 2)

The required background checks for the above cases remain pending. We will render a decision as soon as background checks are complete. If you do not receive a decision within 180 days of inquiry, please contact ... "

The immigration officer (tier 2) who took my service request stated that the missing returned petition was a likely cause that my new petition was pending for such a long time. How do I get them to do anything about it?? When they won't even attempt to look for the file??

How the hell are they conducting background checks on a file they have LOST??? We have already successfully passed through all criminal background checks once so this has got to be about the previous denied petition. Which they don't HAVE and refuse to look for. This is just maddening. I am going to pass this on to my congressional aide tomorrow but they haven't been able to get any better info out of USCIS so far either...

Today is 9 months since NOA1 (2nd petition) and I haven't gotten so much as an RFE....

2009/06/19 - 1st NOA 1 (I-129F)

2009/10/07 - NOA 2

2010/01/11 - interview; result - approved

2010/01/18 - received passport with visa in the mail

2010/02/05 - embassy calls and asked to return visa for a "correction"

2010/02/09 - fiance returns passport with visa to embassy

2010/03/09 - embassy tells us we are in "administrative review"

2010/09/07 - fiance receives passport back with canceled visa and letter; our petition has been returned to USCIS

2010/11/08 - 2nd NOA 1 (I-129F ROUND 2)

2011/04/19 - service request response - 6 months additional extensive background checks

2011/08/22 - 2nd NOA 2

2011/10/04 - interview

2011/10/20 - visa received

2011/11/04 - POE

2011/11/25 - legal marriage

2012/07/21 - wedding with family and friends!!

Hi elya,

I'm so terribly sorry to hear about your situation, I wish I could give you the answers, but instead I can just offer my good wishes.

I think the only thing you can do it write a letter to your local senator or similar, I think they can do something about it.

Calling the USCIS is just pointless in our experience.

Once again I hope you can get this sorted, despite everything it will be worth it in the end.

I'll say a prayer for you that this gets sorted.
