Can my fiance come stay her on a visitor visa then later file for the K1 visa?

It is illegal to misrepresent yourself and enter the US with a visa with the intent of using it for another purpose. A visitor has to leave and has no immigrant intent. Your fiancé cannot come as a visitor with the intent of marrying you and staying during the process.

You can either petition for him as a fiance or a spouse (if you do get married before you apply) while he remains his country. He can visit you during the process. If he does so, he needs to bring proof of strong ties to his country.
