Hi everyone,

I just got married to a USC, and my husband has just filed form I 130 and G 325A to the USCIS. We haven't filed I 485 and other forms, and would like to do so after the I 130 form is approved. I recently got accepted to an one-year academic program in the US. If I choose to enroll the program, my husband and I will have to live in two different states. I am just wondering whether we will be interviewed separately because we live far from each other. Also, will it be harder for us to prove our relationship when we sit for an interview? Since we will file I 485 after I 130 is approved, will it take more time for us to have an interview? I am thinking about having the I 130 form withdrawn and have my husband reapply after I finish my studying. Do you think that the withdrawal will cause any problems for us when we reapply next time? I really need some help. Thank you very much.

Why not apply for I-130/I-485 CONCURRENTLY? Then you have legal status and it is faster overall. Regarding living in two different states, that happens sometimes. It is a negative factor, but it can be overcome with a valid reason. Read the guides up top about a CONCURRENT application. You can turn yours into a concurrent application by sending in the I-485 with the Receipt from the I-130.
