Hey guys I was wondering if someone could answer a question I had. Here it goes:

I am in the process of gathering all my fiance's paper work to send his first package (with 1-129F etc.) However, I am having a little bit of an issue. My fiance's sister (who now lives here in the US) applied for my fiance a couple of years ago (as sister brother case) and that case is still in process and she is waiting to hear back from the NVC since it takes around 10+ years to bring a brother to the US. Now that I am his fiance, live in the US, and am a US citizen I am applying for him on a fiance case.

So i guess my question is that does my fiance's sister need to notify the NVC or USCIS that her brother has a new case now (and how should she contact them) or will they just know when I send my first package to the USCIS.

I am really worried about this and am wondering if the case that his sister filed for him will slow down the fiance k-1 visa case that I am filing.

Any thoughts....please help!!! please and thank u all.

Your situation is a possible red flag for the K1 visa denial as they might think that you are taking the short cut of k1 visa to enter USA asap. My advise would be to go marry and file for CR1 catagory...that way they will be assured that you are not committing any visa fraud...

Yea your right, but I didn't even know his sister applied for him until after we got engaged. And we want to get married here in the US bc most of my family lives here.

So do you think I should tell his sister to terminate his case (is that even possible?) So that I can begin a new case for him.

I don't know how it works, do you think I should get an immigration lawyer or attorney for this question?

First off a CR1 visa will Not assure you being free from them thinking it's a visa fraud. The smartest thing to do is get a lawyer Asap!! Do not ask the sister to terminate anything before you ask the right questions to the right people.

02/17/2012-> EAD Card Received in Mail.

05/04/2012-> Green Card Production Ordered.

05/10/2012-> Green Card and Welcome Letter Received.

02/03/2014-> ROC Packet Sent.

02/10/2014-> NOA1 Date according to Hard Copy.

03/11/2014-> Biometrics Date.

08/01/2014-> Approved (Letter Rcvd. 08/07/14)

08/14/2014-> 10 Year Green Card Received.

N-400

11/02/2015-> N-400 Packet Sent.

11/04/2015-> N-400 Packet Delivdered.

11/05/2015-> NOA1 Date according to Hard Copy.

12/01/2015-> Biometrics Date.

04/07/2016-> Civics Exam and Interview (Rescheduled from 03/01) PASSED!

04/27/2016-> Oath. I am a US Citizen. This is how this journey ends!

I agree with this advice. You should get a lawyer asap and take their opinion..they are the experts...people on this forum are nice and really want to help each other but in the end their opinions, advice and experiences are based on their own individual cases and experiences. It also differs from country to country..so bottom line is...get an experts opinion before moving any further with anything...

I agree with this advice.
