My Fiancee had her K1 visa interview at new delhi a couple days ago and was treated horrible by the CO. The CO that interviewed her asked her stupid questions which my fiancee answered and then said I can not issue you a visa and gave her a 221G which says, deposit more evidence at VFS with your passport. At the interview my fiancee had Phone records, phone cards, engagement album, banquest hall receipt, notarized leteers from me and my parents stating the engagement took place, my fiance letter of intent, her fiancee letter of intent, sworn affidavits from her family and parents saying our engagment took place and they agree for her to marry me when she enters the US,list of family members that intended the engagement, passport copies showing entry and exit stamps, I the petitoner have also been to India 2 times after our engagement, my fiancee also had her pcc and passport clearence with her, passport phots, postal items sent, birth certificate, emails sent and recieved, and we had additional phots of us together. Even with all this stuff the CO said I do not want to see any of this. Now we have a white 221G and have to submit it all to a VFS. Does anyone know how long this process can take. Thanks and any advice will be aprreciated.

I would recommend going IR-1 route for india. Seems they have a thumb rule that indians don't meet up with their fiance's before they are married and they also have this notion that you are married and pretending to be fiance.

Please provide more details.. for me to recommend.... are you inter racial couple?

I would recommend going IR-1 route for india. Seems they have a thumb rule that indians don't meet up with their fiance's before they are married and they also have this notion that you are married and pretending to be fiance.

Not quite true....many have received visa in this category...it depends..

That is big RED FLAG right there.... your fiancee is older than you.....it is not a norm in Indian custom....anything what is not a norm will be taken as a fruadulent mis use of K1 visa...I would recommend... you go there in your second interview...

Thanks for your information. Would you know how long the administrative processing takes. Why would less than 1 year of age difference be the problem.

Sometimes people experience issues at the New Delhi embassy because their engagement ceremonies too closely resemble a marriage ceremony. They could just be looking for clarification that you are both free to marry.

I don't think that less than 1 year of age difference is that big of a deal. There are couples on VJ at the New Delhi embassy who had no issues even though the woman was a few years older. I think this mostly matters if the woman is out of child bearing years and neither person has children yet. They don't want the man to be denied his right of fatherhood.

The fact that they asked her to deliver her passport with the evidence indicates that they do intend to issue the visa if you follow their instructions.

You stated that your fiance had all of the evidence at the interview. Did she bring the evidence with her to the interview or did she deliver it to VFS prior to the interview as instructed in Packet 4 and on the embassy website? If she just brought it all with her, I can understand the 221g. You can't expect the CO to review all of that right then and there, they've got other appointments. That's why they want it in advance to prepare.

She submitted everything at VFS about 12 days before the interview, and the way it seems is that the Co did not even review the evidence before hand. She asked my fiancee if we were really engaged and that indian engagements are a big thing, like your supposed to have a party and all that, my fiancee said we did have a party at a hotel and there were about 120 people there, then my fiancee said here is the album and banquet hall recipet take a look, then the CO said no I do not want to look at the album, nor do I want to look at anything you have. The CO then said if your fiancee has been here 2 times after the engagment which was in JUNE of 2010 why cant he get married here and live here with you, why do you have to live in the US after marriage lol, I do not know what more they want. The white 221G that thye gave says submit the following documents with your passport at the nearest VFS. Everything they want submitted we initially submitted prior to the interview, maybe they just did not review it. Can any one tell me how long it takes for them to review everything now that we are submitting all the same stuff with a white 221G.

Hi Hr8687, Most important thing is .....PLEASE mention what they have asked to submit.......help is available here if you be honest to tell everything clearly....that will be very useful next time you submit anything with consulate.....please tell us exactly what they have asked to submit...word by word....no vague detail....this information itself will tell many things to VJ member who are helping you out....thanks...please forgive me being more sarcastic....

We had our 2nd k1 interview in Delhi last week. We both noticed something...a lot of denials are due to miscommunications. If your fiancee is not fluent in American English that might be the reason. she might not be understanding the question asked. For us, our interview was going fine and then my honey answered a question and then the CO got super aggressive asking him questions. I finally told my honey, "Honey Listen". then he finally was able to give the correct answer. Later we talked about it, and he said both me and the CO misunderstood him. We realized it was due to how American English is spoken. I saw this with another man too. I felt so bad for that guy - we all heard his answers and I knew he wasn't understanding the questions. I also saw that they will expect American answers - aka honesty and no covering of embarrassing situations. I don't know how to state this but in India and Mexico, people will give a polite answer instead of the truth to not be rude or to protect their honor. However, CO will want plain honest answer and not a cover up polite answer. I hope people can understand what i mean. that poor guy was giving confident yes answers but not giving the CO the detailed info that the CO wanted.

i also noticed that for indian couples that were both present - the CO would still interview them separately or ask the indian USC to stay away from the counter. We saw one couple get denied. The USC Indian man was so mad that it was denied and made a scene, but the CO (an Indian women) kept telling him, sir she didn't answer the questions correctly, i gave her a lot of chances etc. when he asked to see a supervisor, she said she was the supervisor. but we also saw other indian couples approved too.

They gave my fiancee a white 221g and said submit the followimg documents with your passport at the vfs closest to you, the following items were told to be submitted, notarized letter froom petitioner family stating engagememt took place, affidavit from benificeary family saying events took place, list of engagement ceremony guest and there phone numbers, voter id cards and voter list forbenificeary for last 5years, notarized passport copy for us citizen, and they want engagement photos, which we have a album and dvd of
