Hi everyone my names Jayson im 24 years old and a born citizen of USA, i have, registered an account with this forum to see if i can gain back some self confidence about my situation, and for much needed help i haven't been finding much anywhere. i thank you all so much for any responses i get, i really mean it, Here's my story.

Im in love with a girl who lives in Lithuania shes 21 years old and, we would like to get married very much, i have been very stressed out and loosing some sleep not being able to find a job for months, im unemployed with very little in my savings for the time being. she also does not have much money, her family is struggling in Lithuania but not as much as mine. My friends and family know how much i care for her and they say they would co sponsor us on paper to support me and her, but i don't know if it is possible, also i live in a housing apartment complex and would maybe be moving to my sisters since she has a big home if we marry, and she were to come here. im living with my mom and dad right now in the housing apartments and neither of them are employed but other family members and friends will help anyway they can they say. i was also planning a trip to meet her in Spain this January where my cousins live since it's less expensive then going to Lithuania for me, and also since we never got a chance to get pictures of us taken together, i thought it would help having the pictures for the k1 visa interviewing processes she would have done in the embassy of her country before coming here to marry, i read they need to see proof we have met and been together when questioning her.

please tell me if my ways about doing this are ok. with the spain trip and all i've been depressed lately because i have never loved someone as much in my life and she the only one i want to be with, also my mom is sick with lupus and doesn't have much time left the doctors say and she wants to see me happy before she passes i know. As for me im continuing to search for jobs but it's just so hard no employer calls back or even gives me a chance to prove myself.

i try to spend my time helping friends and family who need really it to distract my mind from the many complications im having but if anyone can help me with this one thing i will greatly appreciate it.

At the top level -- while skipping the specifics -- the K-1 requires you provide proof that you two met within who years of submitting the visa petition, regardless of the location.

Secondarily, either you or a co-sponsor has to meet the minimum financial threshold for the I-134 Affidavit of Support which is presented at the interview. After that, either you or a joint sponsor has to do the same for the I-864 for the Adjustment of Status once married and stateside.

Keep in mind that submitting the K-1 and Adjustment of Status, as well as the incidental fees, will cost you thousands of dollars --

We can all empathize with loving someone, but the process is more about the procedural nuts and bolts of an immigration process than anything else. And working that situation out realistically is what contributes to success, whereas how you feel about it really has no bearing whatsoever.

If you have a willing cosponsor and joint sponsor that will go down on paper for both steps, so long as you both have a clean history and there are no extenuating circumstances the fact that you have no employment matters none. I wouldn't suggest you bring someone over to the States when your own life is not stable or in order, but that's a call you'll have to make.

Thanks for your honesty. If my brother in laws, brother makes 85,000 a year will that be a good enough co sponsor, or will it be better to find another as well?

Again, you really need to do yourself the justice of reading the K-1 Guide here in the forum. Educating yourself on how it all works will dispel a lot of the mystery:

Generally, though, the first evidence you need is the boarding passes from visiting her, the passport entry/exit stamps, etc. After that a 8.5 x 11 sheet of paper printed with six photos (with captions stating the date and location) worked for us.

Folks go crazy and add emails, love letters, chat records, etc., but it is arguable whether all of that is necessary. And I don't know the specifics for the Lithuanian consulate -- mileage varies by location. I'm sure someone will chime in with more info on that.

I couldn't tell what you meant: is this $85K coming from one person? One brother-in-law? For the initial I-134 you can only have a single cosponsor. Later, during the I-864 (Adjustment of Status), you can have more than one.

If it is one person, even without knowing how many dependents he has I'd suspect his income would be enough...

You need to prove that you two have met within 2 years of filing. If you two are planning to meet in Spain then don't forget you need evidence to prove you were both in Spain at the same time. If she has an EU passport remember that within the EU, EU passports don't get stamped and a US passport only gets stamped at your first point of entry in the EU so even your passport stamps may not get stamped in Spain. So you will need other receipts and things to show you were both in the same place. Even if you could get both your name on a hotel booking and/or receipt. Get pictures of both of you together with dates on them.

You don't really need to provide a lot of evidence of relationship for the USCIS petition. Also for the USCIS don't provide pictures older than two years cause theit concern is 2 years ofr less. But for the embassy stage you will need to stress on your relationship and ongoing relationship. So there you can show them old and new pictures.

Your brother in law can be a co-sponsor as long as he's a US green card holder or citizen. You and he will both have to fill out a I-134 each. I suggest you read the K-1 guides posted here on VJ.

P.S. I believe Lithuania does not process K-1 visas and your fiance will have to do the interview in Poland. It used to be that way for a while but I still believe Latvians and Lithuanian K-1s are done in Poland.

I would not suggest old emails as they can be easily forged. What worked for us was photos with both of us in them. Record the date and location on the back. Also copies of plane tickets or hotel reciepts showing that you were both in the same location at the same time. If you go to Spain, her passport will not be stamped (both Spain and Lithuania are EU countries) but as long as your passport shows EU entry and exit stamps and you have photos of yourselves at an identifiable location in Spain, you should be fine.
