Part 6 Sponsor's Income and Employment

[x] Joint SPONSOR's income indicated on the I-864 Part 25 does not correspond to that

shown on the most recent tax return and W-2(s).

My father in law is the joint sponsor and he's filing taxes jointly with her wife.

He is the only sponsor I have apart from the petitioner.

As He is filling taxes jointly with his wife then how does he separate his income from his wife ?

In the form i864 Ques # 24 a © = individual income

In the form i864 Ques # 25 = individual income or combine income ? coz the irs form shows combine income of both the joint sponsor and his wife

Plz help me out

USA

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

You show the individual's income. If they are a wage/salary earner you would support the income claim with their W2 information.

If both in-laws' incomes are needed then one completes the I-864 and the other an I-864A.

Disha9, item 24A gets the amount from item 23, which is the current individual annual income (annual income from 2011), where as the item 25 has income from 2010, 2009 & 2008. Hence the amounts in 24A and 25 will be different in most cases.

Futher please check if the your father-in-law included copies of his W-2 to indicate his income, as item 25 indicates the joint income for 2010, 2009 & 2008. And you also need an explanation letter stating the same and NVC then shouldn't have any issue.

Check these and submit a detailed expplanation letter along with the missing W-2s, if any (the IRS Tax transcripts or the full set of Tax returns filed should have been sent for 2010, 2009 & 2008).
