Help! Lost I-94 but have a photo copy in hand. Should I apply for a replacement for AOS interview?

Hi everyone,

Here is my situation:

Entered the country with F1 (still have the original I-94)

Found my first job and got and H1B (New I-94 was sent with H1B status on it)

Found my sencond employer, left the first job and apply for a new H1B (I only have a photo copy of the I-94 with my new employer's name, my immigration status and expiration date on it)

Now I am happily married to a US citizen and preparing to file AOS myself!

Her are the questions:

If I send out my AOS package (send them my I-94 copy), would they ask for the "original" I-94 at the interview?

If I do need a replacement (now it is $330.yikes!), can I file it concurrently with my AOS package?

What should I put in I-102, Part 3 Are you filing this application with any other petition or application?

I think if you have a copy of both sides of your I-94 you should be fine, at least for the AOS filing part. But if you do have an interview and they ask for it they might find it strange and start questioning about it. Hope you don't need to pay $300!!

Yeah, I do have the front and back photo copy.

Anyone can comment on if they ask to see the original of the I-94 at interview?

Yes, they ask for the original I-94 at the interview. They usually take it. You will have a mandatory interview, because you did not enter on a K-1 visa.

They didn't asked for my I-94 but because I came on a VWP, I told them i never had it in my possession. You can also photo copy the passport stamp of your last point of entry / passport photo I.D page.
