Financial Requirements

Hi all,

My fiance and I are expecting our NOA2 at somepoint in the next month or so, and we are a little confused as to the what the requirements are on the financial side of things.

What we are confused about, is which one of us has to meet the financial requirements? Earn more than the current proverty line.

My fiance is the petitioner and I am the beneficiary. My fiance's current income does not meet the requirements, however my income does.

It is your petitioner's that needs to meet the income. Unfortunately they don't take yours into account at all, which is annoying. Your petitioner HAS to be the main sponsor so if she doesn't make enough she'll need a co-sponsor.

For adjustment of status they will consider your finances too, since you'll be married.

It is very logical actually - what do you think beneficiary income will be once he/she comes to US and will not be allowed to work for a while (at least, not even speaking about getting a job later) ?

Because I dont have a job (recent graduate) but a lot of savings that could prove I would not be a financial burden and I wish they could take that into account and not my student boyfriend's part-time income.
