My fiance and I have been jumping between ideas of which visa to pursue, fiance or spousal. I always thought that in order to be eligible for DCF the USC had to be a permenant resident of the country abroad, in our case Canada. I have been living in Canada (only traveling home for Christmas and a summer holiday) since September 4 2009. I have been legally living here with:

-study visa

-off campus work visa

-university health insurance plan

-SIN card

My DL and passport are still my American ones, I called the embassy today to ask, and they are closed for holidays until WEDNESDAY!! haha...so basically I am being impatient and hoping someone here can give me some insight! Thanks in advance! :)

No, you only have to be resident for tax-purposes.

And have you considered employment-visa (such as TN-1) as an alternative?

2005/12/21 Visa Interview Date

2006/04/04 Pras' entry into US at DTW

2006/04/15 Church Wedding at Novi (Detroit suburb), MI

2006/05/01 AOS Packet (I-485/I-131/I-765) filed at Chicago

2006/08/23 AP and EAD approved. Two down, 1.5 to go

2006/10/13 Pras' I-485 interview--APPROVED!

2006/10/27 Pras' conditional GC arrives -- .5 to go (2 yrs to Conditions Removal)

2008/07/21 I-751 (conditions removal) filed

2008/08/22 I-751 biometrics completed

2009/06/18 I-751 approved

2009/07/03 10-year GC received; last 0.5 done!

2009/07/23 Pras files N-400

2009/11/16 My 46TH birthday, Pras N-400 approved

2010/03/18 Pras' swear-in

I forgot to mention that I filed taxes here in Canada last year! ...and no I am still a student so I don't believe I am capable of getting a regular work visa until I graduate, but my fiance and I want to return to the states after my graduation.

Clarification: TN-1 is a US work visa for Canuck, not other way around.

DCF is for family members? I am not sure that if you are unmarried your fiance is eligible for immigration benefits while you are living overseas.

we would get married before attempting DCF ... but I need to make sure I am able to file DCF before getting married, because if not then we are going the K1 route.
